    Thanks

What is SOGA and also procedure for rejecting the car??

I downloaded a template from the WHICH website and sent this along to the dealer. Is this the correct procedure??

If you google/ask/bing it you would be able to suss out exactly what you need to do. I haven't read the WHICH site one.

Sale Of Goods Act, it covers secondhand cars.

    Good luck with it.

What was the actual breakdown? guessing it was a bust radiator/split hose? Did you contact the selling dealer to let them know before you got it fixed elsewhere?

I feel your pain, I had a MINI and the gearbox failed. They're lovely when they're working but expensive to fix. My sister too has a Mini Cooper and her airbag light came on for no reason, took it to a local garage and he said it could be a dry sensor. About 18 months later, the light has gone out. Not sure why it came on in the first place.
With the tyre pressure light watch this video on how to reset it http://www.youtube.com/watch?v=XF1yMPQsVYc
You could have a puncture or it could just have low pressure. Runflat tyres aren't as cheap as bog standard tyres, so expect another pricier cost for a new tyre if thats the case. Wishing you luck with the repairs!

Yes I did contact the dealer when the car broke down and he just told me to ring the warranty company as he does not fix on-site. The car was towed to the garage and the only way to get it home was to have a new rad and bush. I was happy to pay this as it meant I could bring the car back home and it is not until I went to collect that the mechanic dropped the bombshell that the gearbox was completely goosed:(

Yes, it overheated and broke down and it was the radiator that had a leak.

When it broke down you should of insisted that the seller deals with it. The seller is ultimately responsible and as such, their call to involve the "warranty company". No way should you of paid £300 although you should be able to recover this.

The warranty is merely in addition to you statutory rights that you already have under the Sales of goods act (SOGA). Your claim is against the seller (and/or finance company).

Contact the seller tomorrow and ask what they intend to do. Mention that is up to them to claim off the warranty because you still have the sales of goods act to rely on.

There are 2,800 Mini Coopers on Autotrader. 20 of them are offered for £2k or below. Of those, just 11 are from trade sellers. Two of those have write-off history, one's listed as spares-or-repair, whilst one has a big dent in the side. That leaves you SEVEN apparently straight cars of that price range to choose from. Nationally. They're nearly all 51-plate, so coming up to thirteen years old. Is £2k strong money for a car of that age? Broadly, yes. But for a car of that model and age? No. And that's the standard SOGA judges by.

For used products, SOGA manages your comeback on the supplier according to reasonable expectation for the age/price for that product, and that product alone. Given that you've bought at the VERY bottom of the price range, having a well-known fault develop shortly after purchase is not necessarily grounds for refund. The symptoms sound obvious enough that, if they'd been present at purchase, any reasonably informed purchaser would have noticed them.

On the bright side, it looks like a recon box is about £400 and four hours labour, so less than half the cost you've been quoted.
http://www.norfolkcars.co.uk/mini-service-repairs/bmw-mini-gearbox-repairs.htm or http://www.minigearboxes.co.uk or http://www.minigearbox.co.uk (random google results)

As far as the "Should have failed MOT" and cooling system faults go - you've got no comeback on either now the car's been worked on. MOT recourse is via VOSA but explicitly requires the car to be in the condition presented for test. Comeback on any issue via SOGA is via the vendor. You cannot expect him to pay a bill that's just handed to him as a fait accompli.
