Landlord's shelf collapsed, damaged my stuff

    If you have any valuable items, you can either:

    1. take the risk yourself (i.e. pay to buy another if it damaged), or
    2. transfer the risk to another party. This is called insurance.

    If you had no insurance, then you need to take the risk yourself. You cannot transfer the risk to your friend's LL - they are not an insurance company.

    The Vision of Escaflowne (天空のエスカフローネ Tenkū no Esukafurōne?, lit. Escaflowne of the Heavens) is a 26-episode Japanese anime television series produced by Sunrise Studios and directed by Kazuki Akane. It premiered in Japan on April 2, 1996 on TV Tokyo, with the final episode airing on September 24, 1996. Sony's anime satellite channel, Animax also aired the series, both in Japan and on its various worldwide networks, including Hong Kong, Taiwan, Southeast Asia, and South Asia. The series is licensed for Region 1 release by Bandai Entertainment.

    The series follows a teenage high school girl named Hitomi, who finds herself pulled from Earth to the planet Gaea when a boy named Van appears on the high school track while battling a dragon. In Gaea, she is caught in the middle of a war as the Zaibach Empire attempts to take over Gaea. Van (King of Fanelia), with aid from Allen (an Asturian Knight), commands his mystical mech Escaflowne in the struggle to stop the Zaibach Empire. Hitomi's fortune telling powers blossom in Gaea as she becomes the key to awakening Escaflowne and to stopping Zaibach's plans.

    While the anime series was in production, two very different manga retellings were also developed and released: a shōnen version of the story entitled The Vision of Escaflowne and a shōjo retelling titled Hitomi—The Vision of Escaflowne. In addition, a second shōjo adaptation called Escaflowne—Energist's Memories was released as a single volume in 1997. The story was novelized in a series of six light novels by Yumiko Tsukamoto, Hajime Yatate, and Shoji Kawamori. A movie adaptation, Escaflowne: The Movie was released on June 24, 2000, but bears only a basic resemblance to the original series. Four CD soundtracks and a drama CD have also been released in relation to the series.

    If one runs a more sensible search on these "hard to find" "valuable" figurines, what turns up is what I would generally refer to as "tat".


    If insurance was available I do not think the policy excess is going to be in any way troubled.

    It was the first (and only) one of that edition I found, and was provided to illustrate which one it was and the weight of it, there's a lot of cheaper and lighter merch from the same show out there but I don't own any of the others, except the freebie that came with the DVD boxset. In any case I'm not buying a replacement from bloody California.

    I guess that yes, it's gone, still pretty crappy luck though, it's not /that/ heavy.

    I'll strike it off the list of things my friend needs to nag the landlord about then, and just go with the dodgy electrics, the mould/damp, the boiler that can only hold pressure for a few hours as it's pouring hot water down the side of the wall. Though with those and an impending move, probably better to just report it to the environmental health while moving out, or are those our fault too?

    No, those are the LLs fault.
    Failing to look after your possessions is your fault.

    You stated in your first post the damp and mould was there before you friend moved in....why move in and moan after? I wonder if she was happy living there until you moved in and started picking faults?

    I don't think it's great that the shelf was put up incorrectly. It sounds like the type where you can't see how well it's been done unless you take it off the wall - most people would test stability by giving it a little tug and seeing how much it wobbles! What if it had fallen on someone's head? :p

    Personally I do not trust wall-mounted shelves at all - there's a corner one in one of our bedrooms and I've just got a canvas picture on there and a little Bluetooth speaker which would fall onto the sofa bed below and probably not break (it was free anyway so wouldn't be any great loss), but I wouldn't put anything I was really fond of on it.

    I think morally the LL is at fault for being incapable of basic DIY, but that a replacement would have to come out of your own pocket :(
