car accident - little damage

    i have notified my insurance but not claiming at the moment.

    Can the other driver make a claim in a few months / years time out of the blue?

    6 years for physical damage (5 in Scotland) and 3 years for injury

    presumably that right also applies to me if the paint work starts to flake in the winter months?

    If you claim in years to come expect problems proving flaky paint isn't wear and tear or manufacturing defect.

    And that the problem isnt caused by your lack of action/ delays.

    Your current insurers would cover defending and third party claim that originates from an incident that occurred during the period of insurance. If the incident involved the injury of a minor then they actually have until their 21st birthday to make a claim so you do get claims 20 years later in rare cases. This is effectively governed by law and not just the policy wording

    Claiming off your own policy for own damages is defined by the policy terms, the majority dont specify a time limit but in theory they could. If you had left minor damage that could have been repaired and allowed it to rust resulting in the panel needing to be replaced then the insurer would only be responsible for paying what the original repair costs would have been not the extra damage caused by inaction
  • Just claim off the third party. Don't be bullied into letting it go.

    Someone scuffed my bumper on a brand new car, well I say it looked like a scuff, but the bumper was damaged and the number plate light holders were damaged plus the paint was blistered, in the end it cost nearly £2k for a repair, I let the accident management company deal with it, I notified the insurance but not made a claim via my insurance.

    I have told my insurance company who have put it down as notification record for now. My question is - who else can see that information on a database? Will this cause issues in future when I part exchange the car? I am not sure if they ask if it has been in an accident?

    Only a total loss or stolen not recovered is marked against the vehicle itself. The rest is just held in CUE which only insurers have access to
