Fake Charge, just need some advice!

Afternoon all,

Quick background of the story is, I was having dinner with a friend and while I was waiting for the receipt, someone from UK Parking LTD was putting a 'Parking Charge Notice' on her car. The ticket ran out at 9.25, and we got back to the car just before 9.35 (ticket issued at 9.32) so we're only just over the 5 minute grace period.

Now, the car park is clearly labelled as a private car park, and after reading through vast posts about this, it seems that UK Parking LTD are essentially scammers, and cant do anything as we were only issued with a Parking Charge Notice, not Penalty?

Now, the fact she got the charge was totally my fault so I insisted that I will pay it, but after reading on here,...I don't think I'll bother, but that gives me a couple of issues which I need clarification on:

If I ignore it, she will get some form of notification from the sister company Debt Recovery LTD or whatever it is, but I don't want her to receive it and pay it in panic,...so my plan is to put me as the named driver on the ticket so she won't get any hassle or correspondence, but if I do this, I assume they will completely take her out the loop? And secondly if I ignore it as this website suggests and they get nowhere with me, they will still leave her out of it?

Either way I now have the ticket and they won't be getting any money from me, but I want to completely remove her from the situation. We were literally 7 mins late, so I don't see how this can stand given the fact that it's a private car park anyway.

Any suggestions?

    just read and follow the advice in the NEWBIES sticky thread at the top of this forum, which is all about private parking tickets (which are not fines or penalties, they are speculative invoices)

    "what happened" is rarely relevant

    the RK can appeal it , or name you as driver so you get a PCN and appeal it , or you name yourself as driver and appeal it

    What 'website suggests'? This forum doesn't advise ignoring a fake PCN unless it's in Scotland/NI. And the MSE 'Guide' is old and outdated.

    Debt Recovery Plus are not a sister company of UKPC*, they are a debt collector firm. They send letter, as explained here, and are not bailiffs:

    Anyway just send the template appeal from he NEWBIES sticky thread NOW, before she is bothered by any letters but give your name and address and say that you were the driver (rather than keeper). That way they cannot write to her at all and you will have taken ownership of it. You will win at POPLA like we all do on here since early 2013!

    Complain like mad to the restaurant, you should not have to bolt your pudding because some ex clamper says so. If the restaurant is on Trip Adviser mention it there.
    You never know how far you can go until you go too far.

    Apologies for not reading the sticky first,...I know how annoying that is being a regular member of another forum!!

    So, please accept my apologies.

    After reading the sticky, it seems that it suggest the Named Driver (which in this case will / should be me) has less grounds for an appeal,...but from what ive read of other posts,...I should just go ahead, name myself as the driver and (hopefully) successfully appeal it,...

    It seems I can appeal online which I will do shortly (unless advised otherwise) with a template letter,...but is there any particular one I should use for being the named driver?

    What makes it more difficult for a named driver anyway, or have I misunderstood?

    The youtube link doesn't seem to work for me,...just says video unavailable for all of them.

    And as for the company, it is UK Parking Limited (or so their logo suggests) and at the bottom it says they are a member of BPA.

    I have a picture of the ticket (with details removed) but I don't think I can upload being so new.

    **Edit - It wasn't the restaurants carpark

    Personally I would actually appeal in the friend's name as keeper but giving YOUR postal address. I would treat this lot as if they are 'small fry' as explained in the NEWBIES thread, which means sending the template appeal in the friend's name around 21 days after the date on the ticket. Even if emailing the appeal, include the full name and postal address (but use your address as I have said; this is allowed as the appellant only has to provide an address for service of letters).

    Then you can handle it all but you will not have thrown away the point that the keeper is not liable (they won't be because this PPC won't get the paperwork right if 'she' appeals as keeper after 21 days). Diarise it now so you don't leave it late, as they are allowed to look up her data with the DVLA after 28 days.

    Appealing as driver in your name would be throwing away too many good appeal points which will win it at POPLA without a doubt. And don't send the appeal early.

    Apologies to drag this one back up but it I now need a bit more advice.

    I followed the suggestions on here, and kept my friend informed, and as such we appealed in her name and address (as it should be) but this was some months ago,...

    The first time the appeal went through, the Parking company came back with a response (copy and pasted legal talk), and ended it with "would you like me to use your email as your appeal" to which I responded "yes"

    This was some time ago, and my friend said she is still yet to receive anything in the post. I am writing to ask about what timescales she should expect to see something?

    Also, I checked the status on paymypcn.net and it says that its been referred to Roxburghe (UK) Limited but she hasn't even received anything yet so am unsure why its gone to a Debt Collection Agency.

    I'm starting to think that their delayed response where they copied and pasted the legal terms was to buy some time for some reason?

    The appeal was sent on the 21st day as suggested.

    put a complaint into the BPA and add copies of the pcn and appeal and dates etc , mentioning that it appears they have ignored the appeal and passed it to Roxburghe for debt collection , just to cover yourself

    make sure the appellant does this (the person who will be receiving the paperwork)

    35 days is the BPA CoP limit, so mention that too if its longer

    6 years is the ultimate MCOL limit , by statute

    Don't forget not to imply who driving in any communication or complaint. And because the PPC has never sent a Notice to Keeper, there is no 'keeper liability' in law!
