Bos ppi payment made to ex in error

Hi, looking for advice.
I had a 25k 10 year term joint loan with my ex and when we separated a year and a half into the term, as part of the Minute of Agreement, I took on the loan myself. Successfully claimed PPI and was informed payment of 38k would be made. However, they sent a cheque to me for half and a cheque to me ex for half. She would have been 'due' monies for the year and a half we were together....
In trying to get the money from her amicably, no joy.....
However, when the Bank of Scotland sent a letter stating the payment that would be made, they said that if unhappy with the offer, I had 28 days to inform them.
Duly called the next day to let them know that what they had done was wrong. On returning home, I found that the cheque had already been sent to me and found out my ex had received a cheque the same day. So, hardly 28 days.....
Have I any recourse on BOS regards this?

Did your ex get removed from the loan after 18 months or did you leave her name on there?
The usual outcome is for the money to be split 50/50 on joint loans. So, unless she was removed from the loan, you are going to need to deal with her. If she was removed from the loan, then you have a stronger base to argue from.I am an Independent Financial Adviser (IFA). She was removed from the loan. Original solicitor dealing with this was as much use as a chocolate fireplace.
Have a litigation solicitor on the case now, however, fees getting hefty.0
