Help legal advice

I'm looking for some help there's not a tab for legal advice on the forum.. But I'm needing some advice ASAP

I was sexual abused as a child and 5 years ago I report it to the police when I was 18! My abuse was from 11-16 I'm autistic and the person that abused me was deaf the CPS didn't let it go to court as they didn't agree that 2 people with disabilities would copy being in court I was happy todo it tho but the police told my mum that I should apply for compensation from cica witch I did and was awarded £22.000 since iv been diagnosed with a bowl issue witch is linked to my abuse I feel iv been let down because the police are agreeing it happened but he didn't got to a trial as he's deaf :-/ I'm now 5 years on wanting todo something about it I have my own children and feel he should be locked away for what he done.. My issue is how do I go about getting th case looked at again ??

    If the abuser accepted a caution, I think that is the end of the road from a criminal law perspective, so you will not succeed in having him prosecuted for this offence I am afraid.

    You are also out of time to bring any civil action against him, unless your bowel injury was only discovered within the last 3 years. Even then, you would have to pay back the CICA award if you recovered compensation from your abuser at this point.

    I am sorry not to be able to give more optimistic advice.
  • The only way is if he has abused others who haven't yet come forward.

    no advice, just sending some love your way because i have been in your shoes. only i didnt report it to the police and it was actually members of my family that did it so i understand why you are still carrying this with you. i'm afraid to have kids for the very same reason.

    The above is the guideance on challenging a CPS decision. Unfortunately in "normal" circumstances the timescales are far too long. It does say in some of the other linked pages that cases of the most serious crimes and/or particularly vulnerable victims have special considerations but doesnt elaborate on what those would be.

    I would fear that the length of time passed may mean that they wont/ cant review but ultimately you wont know unless you do actually try

    And there is a reason for that: the only way to get legal advice you can rely on is to pay for it. By 'rely on' I mean sue the pants off your adviser if they get it wrong.

    But I'm not sure why you think the answers will be any different to those you got here.
