Second hand car deposit

Been a bit of a berk.
Saw a car that I sincerely wanted to purchase. Paid a holding deposit for it of £500 in mid February. Car was a Japanese import and needed to get SVA'd etc. Importer did this and emailed me that it was ready at the beginning of March.
I was super busy at the time and never replied. He sent me a further email mid march saying if he didn't hear back from me he was taking it as read that I didn't want the car.
I didn't email him and subsequently he sold the car and has not repaid the deposit.
He did have my phone number since the start but never once called me.
Does anyone know if he is correct to keep the deposit?

Not too sure but I would say that he would be right in keeping the deposit.
He gave you ample opportunity to collect the car and for whatever reason you never got back to him.
You could have vanished off the face of the earth as far as the seller was concerned.

erm - if you are implying that I didn't have the cash - just so you know I ended up getting a new car instead which is being delivered this week. for info seeing how you are so keen to presume; my issue was the dealer was 200 miles away and I couldn't find a day to get down to complete the transaction.
and no the issue isn't about paperwork - apparently there can be a case to cover losses they may have incurred due to depreciation. in this case the car is appreciating so that goes out the window.0 -

In cases like this I find that the phone/email are great tools - if delivery time wasn't of the essence then I'm sure you could have come to an agreement for it to be delivered but instead you chose to ignore the seller0 -

And you couldn't find time to pick up the phone or write a quick email? I assume in all of that time you didn't once post on Facebook, text a friend, read a newspaper, take a bus, eat a sandwich?
You need to sort your priorities out, that's very bad time management.0
