Advice on a CCJ

Options
Hi everyone,

Hope I'm in the right area. I just need a little bit of advice on a CCJ that I've received. A bit of background...

In 2009 I was struggling to pay off a loan and credit card and they went to collections. I agreed a payment plan in late 2009 and had been paying them off regularly every month.

I moved address in 2011 and didn't advise the companies because they hassled me so much at my old address that I figured as I was paying them it wouldn't make any difference anyway.

I've kept on top of all of my payments for five years until I checked my credit score on checkmyfile in March. It listed my credit card as having been settled back in 2012. As you can imagine, I was chuffed I could tick one off my list and stopped payment, and didn't think anything more of it.

Yesterday, I received a notification of attachment of earning earnings from the court. HSBC have told them I still owed £900 and the court have ordered my employer to deduct £150 from my wages each month for 9 months.

Is there anything I can do about this? If the money is due then fine (I know I should have called them to check but didn't think mistakes like this would happen on a credit search)

Is it worth me spending the money to try and get it set aside, or am I likely to fail because I chose not to tell HSBC I'd moved? I know I'm not blameless in all of this but I've tried so hard to get my finances back on track and my defaults were due to drop off next year which would have left me with a brilliant score, and an opportunity to apply for a mortgage.

Sorry for the long post, and help would be much appreciated.

Nat

or am I likely to fail because I chose not to tell HSBC I'd moved?

I suggest you'd struggle to convince a Court that your motives were justifiable.
  • That's what I thought! Gutted, but lesson learned. At least I'll manage to save more of a deposit, it just means for the next nine months, I'll be living on £150 a month. Time to visit the frugal forums, lol

    Thanks for the advice :)
