Some accident advice Bike v stationary car!

    One of the reasons I have a problem with groups like SMIDSY (Sorry Mate, I Didn't See You). They assume every accident involving a bicycle and car is immediately the drivers fault. I drive 80 miles a day, give or take a mile, and I've seen a number of accidents and near misses. I'd say equal numbers are caused by cyclists as by cars. Maybe one or two more by cars, but I bet it's close.

    Ironically, in most cases, they're caused by the same things, e.g.:

    - Impatient driver trying to pass cyclist when space is narrow.
    - Impatient cyclist trying to push his way past vehicles when stationary or slow moving traffic.
    - Dangerous driver moving into a cycle lane when lights are on red, or pushing past in a cycle lane.
    - Dangerous cyclist jumping red light altogether.
    - Clumsy driver opening door on passing cyclist.
    - Clumsy cyclist falling onto a car.

    Is there such a group as SMIDSY? To my knowledge it is merely an acronym.

    I forget if that's there proper name. It might be "Stop SMIDSY" or something. They were on 5Live a few months back actually.

    So I went to two body shops today. I am trying to be reasonable but she managed to do quite a bit of damage!
    1) Bumper-repaint
    2) Front wheel arch-repair
    3) A Pillar
    4) Front door
    5) Rear drivers panel dent
    6) Bonet dent
    7) Wheel alloy damaged

    Both said 5-7 days in the shop. Waiting for one quote the other was 2k!! :o

    So im gonna go have a chat to them and see what the say. I really don't want to claim from my insurance or have to goto court.

    Balls!

    Feel for you a lot. She has to be reasonable, if she knows the amount of damage she's done, she can't really complain. Can she not claim on her own insurance?

    Most house insurance policies cover both cycles and issues like this. Really, you need to see if she will settle and pay, or you will have to go through insurance, this is something your car insurance company can do, if you don't want that route it would be the small claw court I think.

    Thanks mate. I love my car and i wasn't even angry just wanted it fixed.

    Just popped over and spoke to her. She has cycle 3rd party liability through CTC. She apologised again and accepted liability...again.

    I just looked quickly online and I think it will cover me. I just hope they don't cause too much of a fuss.

    My insurance company, Elephant, still reckons I should leave them out of it and claim from CTC and if that fails go through them.

    Anyway I have had a quote from a couple of panelbeaters and am waiting for it to come through the post. Its gonna be over 2k I reckon.

    Lady is fine btw she just must have been dreaming. !!!! happens I understand just want my car back to shine!

    Your insurer (despite probably doing so for purely selfish reasons) are probably right - it most likely will be easier to claim directly

    Such is life. I mean, the goodness in me hopes she would have returned later on (when I go cycling I don't tend to carry paper) and perhaps left a note but it seems that kind of conduct is getting rarer and rarer these days.
