DR PLUS cannot take anyone to court for this, neither can they send the bailiffs in , especially as there is no CCJ which can only be applied after non-payment after a COURT CASE

all this scare mongering is designed to bully you into paying and at the moment DRP are trawling through their archives sending out bullying letters before the 6 years is up

you have ignored them this long, so continue to ignore them

be different if you got an LBC or an MCOL in the post , from the creditor themselves , you need to heed those

just ignore DRP and when the 6 year deadline is up for an MCOL, thats the end of it

Is it worth me returning the letters to sender stating the person (being me) no longer lives there. My mother is a worrier so I don't want her being involved if I can help it.
Where the letters and phone calls are going to an elderly worrier, then YES I would do that. Because if another letter arrives or pushy phone call - and they ARE pushy and rude and economical with the truth - do you think she will be scared enough to actually pay it (like you nearly did?). This is a scam, a scraping of the barrel moment but maybe you could write a letter in her name with her address at the top saying that the keeper (DO NOT say driver) of that car moved 4 yours ago and here's their current address, reconfirming your name which they already have anyway. And that if they continue to write to her address or ring her phone number it will be harassment which will be reported to Trading Standards and the DVLA and BPA for pursuing the wrong person.

She has just received a phone call for me from someone which I can only presume is Debt Recovery Plus chasing up because the payment failed earlier.

I haven't lived there for over 4 years so I don't have calls for me at that address anymore. The last thing I want is them hounding her all the time.
They will hound her; IMHO it's highly likely she will fold and pay because she thinks you won't find out and she thinks she will have solved the problem and she thinks it's a real debt! So I would stop this hounding of her now and when they write to you at the new address, acknowledge the first letter in writing so they know the address is yours, and tell them to get lost as it was four years before POFA 2012 and there was no keeper liability in those days. THEN don't respond again unless Excel actually send court papers (they would be daft to try with a 2008 case but it's not 'statute barred' because clearly you received the recent letter and tried to pay and they can see that...).

Just ignore them. It's a last desperate attempt at fishing for soft touches.
If it makes you feel any better we too got the same letter, also for November 2008.
It has been given the respect it deserves - sod all.

Yep but in this case I think Mum will pay it when she gets hounded. So I think the OP should take ownership of the scam to his address, acknowledge one letter and then ignore all the drivel (except court papers of course).
