advice required to help my son please

    Can you put together an SOA (see southern scouser's srickie for first timers on the front page).

    That lists your son's income and expenditure. The debt people will expect that. If £10 is all he has got, they will accept it in the long run, but they probably think he is a young boozer and can cut that back to fund the debt.

    Re legal proceeding, if it come to that and he is paying the £10 and that is all he can afford, then that is what the judge will tell him to pay. So they will not benefit from it.

    Just you need to prove that is all he can pay now.

    Is he claiming JSA?
    Is his ADHD so bad that he isn't capable of making financial decisions? Just because maybe the original company shouldn't have given him the loan, if he did not understand the consequences because of his condition. Might be something else to consider.

    hi and thanks again for your valuable advice
    my son still suffers the impulsivness of adhd ie going for credit for bike just cos he wanted it now.but he has not been on medication since he was 16.
    so i dont think they will take his problem into consideration even though i personally dont think they should have sold him the loan.
    he does not claim any benefits because in his eyes he said it would make him a scrounger even though i have explained that that is not the case so he basically doesnt have any income only about £30 spends a month,off me.he doesnt drink or smoke.he just enjoys fishing.
    if i send a letter saying this is all his income i dont think they will accept it.
    but i am going to send the £10 as you have advised me to do.if it goes to court will he have to attend? this is really worrying him

    we have sent £10 twice now as you advised. we have just received another letter asking for £1,107.96 within 7 days or legal action will be taken. they also state following this there could me a charging order against my property or a visit by the bailiff to seize goods.this is making me ill . any advice would be greatfully received.
    luke has also had an accident on the bike and broke his arm also ruining the bike so we cant even return it.please help

    The debt is your sons so they can't by law do anything to your property and they cannot send a baliff round without it going to court.

    Have you rung the national debthelpline yet I really feel you need some proper advice to boost you a bit. If you fill them in on the background and ask if after confirming things with your son they then speak to you to say what to do, they should be able to help so long as you are together, or could you speak on loud speaker together?

    Babe, they are being deliberately scary in order to frighten you into giving them what they want.

    If somebody calls round, you don't have to let them in or even speak to them, and they cannot take anything of yours to pay for your sons debt. Put the chain on if you're worried. And screen you calls.

    Have you gone to the CAB hon, They can get in touch with this company for you and make them behave.

    Your son has NO income and so he can't make payments. End of.

    There are laws against this kind of harassing behaviour by the debt company that you are having to suffer.

    The CAB can put a stop to it hon.

    Have you written the "only contact me by letter" letter yet?

    They should in this situation actually take token payments of £1 there is no way they can go to court the courts would not take kindly to them bullying in this way.

    Speak to some professionals who can put your mind at rest and make you mad - the madder we get the more determind we are to sort the worms out!

    aw thank you for replying to me its a great comfort.i rang national debtline but they said you have to have debts of at least £15.000 for them to help.we went down to local cab and sat there from 10am until 4pm and still didnt get seen.i work every day so had to take day off so he wasnt on his own as he wouldnt have a clue.cant afford another day off at mo. i will just keep paying the £10 and hope if it goes court they will us continue with that.

    Take a look on the national debthelpline website they have template letters you can use for if a creditor refuses to accept payments give that a go if you like.

    The importance of sending the token payments is so that if it goes to court the judge will see that your son has been making an attempt to pay, not just avoiding the debt. Have you done the SOA and sent it in yet? Just a thought, a judge may not take kindly to your son refusing to claim JSA, but even if he did claim, £10 is a more than adequate offer of payment, considering your son is not working.

    NOW - not sure, due to boyfriend going back to uni for masters and now pgce. Worth it in the long run!
