Legal & General and record retention

This is my first post to the forum, so please be kind to me. I have read other threads and haven't found an answer to my problem :)

I took out a mortgage with Alliance & Leicester in 2004 and was sold a policy with Legal & General to cover me if I couldn't pay the mortgage. I later found out this policy wasn't necessary as I had multiple ways of sorting out the mortgage if I lost my job or died, so I cancelled the policy, however it took my until 2010 to work this out and I'd been paying £19.70/month to L&G all this time.

In 2012/13 having heard about PPI reclaiming I decided to complain to Alliance & Leicester. Unfortunately by this time I'd disposed of all the records relating to A&L and L&G documents. Long story short I ended up with the Ombudsman who told me A&L now Santander had given them proof they'd never sold anything on behalf of Legal & General.

Undeterred I complained to L&G who moving forward to the current date have written to me to say they have no information about the policy ending in 2010 so can't help me. They have cited Data Protection rules saying they would likely have deleted the policy details.

I would be grateful for anybody's advice about whether L&G should indeed have deleted the policy information, and whether there is anywhere else I can turn for help - or just swallow my pride and back down.

    Why was the policy not necessary? I doubt you would ever convince FOS of that. It would pay out payments to protect your prized possession in the event you cant work. It will pay out on top sick pay or any redundancy you may receive. It is also a monthly paid policy. I'm not really sure what you have to complain about. It's not single premium PPI or a useless credit card PPI, its a PPI for your home.

    It sounds like you went through a mortgage broker and it was probably the broker that sold you a Legal and General policy.

    Thanks for your reply. To be honest it seems a little judgmental of you to say I would need PPI on a mortgage but not on a loan. You don't know my personal circumstances.

    I was sold the policy direct by an Alliance & Leicester mortgage adviser. They told me that I needed to get mortgage PPI along with my mortgage (untrue). Whether you agree I should have taken a policy out or not, the fact is that I didn't have to but was told I did.

    Statistically, most people need MPPI. That is why most MPPI complaints end up failing.

    Was it MPPI or life assurance? You seem to indicate it could be either in your first post as you mention death. Plus, L&G were the tied life assurance company attached to A&L. So, this could have been life assurance and/or critical illness or income protection and not PPI.
    Whether you agree I should have taken a policy out or not, the fact is that I didn't have to but was told I did.

    Whether you were told that or not doesnt matter. You have no way to prove you were told it and no evidence will exist that shows you were. It is extremely rare for complaints to be upheld on the basis of unprovable allegations. In these cases, the insurance is then checked for suitability and if it was suitable and no evidence of wrongdoing exists then the complaint is rejected.

    If A&L didnt have a commercial relationship with L&G to provide general insurance products then it would be very easy for them to show that to the FOS.

    You right I dont, but this is your house, one would assume if you were cash rich you wouldn't have a mortgage on it! It's also not me you're trying to convince. PPI is there to pay out so you dont have to touch your savings etc.

    If it were necessary to get the mortgage and you have this documented then it was a condition of the mortgage and you should have gone elsewhere for the mortgage. If you are just saying "the adviser told me" with nothing to back this up, then I might as well be saying "I'm best mates with the Queen" as it stands about the same weight.
