Parking Eye- CCJ

Good afternoon all, virgin poster on this forum, so please bear with me.

I am seeking some advice regarding a CCJ which I have received, which I consider to be 'unjust'.

18 Months ago I was working in Ilford, and travelled up from my home in Southend, a distance of some 30 miles.
In order to beat the traffic, and in an attempt to 'stay fit', I joined the local 'Fitness first' in Ilford which happened to be on an business park managed by PARKING EYE.

I would arrive at the Gym early, at around 6.30 every morning, there are no cars on the site only than a dozen regular gym users.

The restricted parking time for shoppers on the site was an Hour, and an excess of this without a valid ticket would incur a £ 150.00 charge.
However, as a member of the Gym I was entitled to park for up to three hours without charge.

Parking eye had a machine to record the number plate of the vehicle in the gym, however this was frequently out of order, and fines were regularly received from parking eye. These were normally dealt with by passing them back to the manager of Fitness first, who would contact parking eye and have them cancelled.

I subsequently left my job in Ilford, and low and behold, two months down the line I received fine from parking eye.

I received a succession of threatening letters in the post, most of which I simply disregarded.
Finally, upon threat of legal action I wrote back to Parking Eye, with my gym membership card for Fitness first advising of my entitlement to park there for up to three hours, and that I was not in breach of any parking restriction.

Parking eye's response to this was that they would pursue admin costs of £60.00 as I had not responded quickly enough. Frankly I found this laughable, and decided to waste no more time on the matter.

The next, and only other communication that I had received, some months later was a default notice from the courts advising that a default notice had been raised and that a CCJ had been applied, failure to settle would result in bailiffs securing goods from my home.

I finally relented and paid the fine, however payment was made after the 30 day deadline, so the CCJ remains on my file, although marked as satisfied.

I am a hard working, small businessman with a young family who has never been in debt and managed credit and business affairs responsibly. I have had an application to open a new business account rejected, and I am unable to remortgage my house at a rate that I can afford, as I am penalised with excessive interest rates from the bank.

I feel as though I have been victimised by this greedy, merciless company, and would be genuinely grateful for any advice or suggestions on how this may be rectified.

    You may have been victimised by a grasping organisation and most of us on here would agree with you, but to ignore court papers, then ignore the judgement of the court and not pay the charges was, frankly, just plain stupid.

    There were so many checkpoints on the way and you ignored them all. The result of a CCJ is what happens and I am not sure what you expect any of us to do.

    CCJ is a County Court Judgement and that is a historic fact. It is recorded and available to the Credit agencies because you failed to pay and that is as it is.

    This may seem a harsh post, and I ould say that if you had taken decent advice or come here first, then you would almost certainly not have had to pay 1p, but that won't help.

    Your best bet now may be to look at one of the other forums on here or CAB as you are no longer in a Parking Problem scenario and thre are others who may have specialist knowledge on post-CCJ procedures.

    agreed , the main point here is that this is about a CCJ, so is no longer about the circumstances that caused it , so should really be on a legal forum or some other forum that deals with CCJ,s , not parking !

    but use the search word CCJ on here (in the search box) to see other advice about them and usually PE but other companies as well

    a CCJ can be got for various reasons and topics, so once its about a CCJ it should be discussed on a site or forum dedicated to CCJ,s , that is my main point

    there is no doubt this could and should have been handled differently but you ignored all the warnings and ended up with a CCJ , unjust though it may be
