CCJ from Parking Ticket..HELP!!

Afternoon all I desperatly need help. I have read all the stickys and cant find anything to cover my situation.

I recently checked my credit score and found that I had a CCJ from Parking Eye for £165.

The problem is all correspondance went to my former address so I knew absolutly nothing about it.

I left my previous residence in OCT 2012 and apparantly comitted the offence THREE WEEKS LATER. I changed my address on my DVLA licence a month after I moved out ( I know my fault but it completely slipped my mind with the move).

Having written to parking eye explaining the situation, they have been unsympathetic and have told me I have to pay up according to 'Section 4' law.

My argument is, That I have not broke any contract with Parking eye as I DID NOT PARK. The place where they have photos of me was used as a through road and they had no cameras at the back, so they have photos of me entering and then leaving (using the through road again) 4 hours later.

They say I had the chance to appeal (sent to old address)and I never so I have to pay up.

I am trying to apply for a mortgage and other than this I have a great credit record but this has screwed me up.

Help!!! There must be something I can do??

    POFA2012 made the RK liable so you have done whatever you may have done or not done after the law changed , hence the court case and CCJ

    if you can get this set aside and argue your case in court and win and have the CCJ rescinded , then all well and good

    however, I cannot say if this affects your mortgage requirement as clearly that is a specialist area of law

    but the CCJ isnt doing you any favours at the moment , so either pay it and move on to getting it removed from the credit file , or fight it and win (hopefully)

    I am not legally trained so cannot help you further , but feel others on here can help you , as can those on Pepipoo or maybe CAG ? (some of who frequent all 3 forums)

    It sort of shows what scum Parking Eye really are. What company in their right mind would apply for a CCJ that can ruin someone's life chances for a poxy £165 ? Scum and scammers is all they are. All the evidence points to it yet MSE and Parking Eye get all upset when the truth is highlighted.

    As Redx has mentioned you could fight it and get it put aside but it will require time, money and willpower. Alternatively, you could pay Parking Eye and ask them to get it removed. No guarantees but it could work.

    What annoys me is that you could get them a CCJ and there would be little affect if they ignored it.

  • Im more angry that I could have a CCJ against me without even knowing it!! Scary! Also that ive saved extremely hard for years to get together a deposit and the chances of being offered a mortgage with this against me is minimal. Gutted. Ive sent a letter to them stating that they cannot persue me under section 4 as I have not breech any of the terms set out by section 4. We will see what they reply...thanks all

    Let's see what they say. But they DID pursue you, and they DID get a default judgement.
