Renting - notice

Hi,


We signed up for a 12 month rent on a house. It is due to end 25th August.

Am I meant to give notice if I intend to move out or are agents meant to ask me if I'm going or staying?

    Legally you don't have to give notice, you could just move out on the last day and post the keys through their letterbox saying "Bye then".

    What you actually do is let them know that you will be moving out - and when - and arrange for a check out to occur.

    My agents wrote to me to ask me what I was going to do.

    Strictly speaking you don't have to give any notice if you intend to leave on or before the last day of your fixed-term tenancy. That's why it's called a "fixed-term". In the real world, if you want to remain on good terms with your landlord and their agent, it makes sense to give some notice so they can make arrangements for a check-out inspection to be carried out so you can get your deposit back.

    Agents are generally on the ball with offering a new fixed-term AST so they can screw yet another fee out of you. If it suits, you could choose not to sign and go on to a rolling periodic tenancy but that may not be secure enough for you as it only requires the landlord to give you two month's notice before they can go to court to end your tenancy. Still, if you pay your rent on time and look after the property any sensible landlord wouldn't look to end your tenancy. But that doesn't necessarily align with the agent's interests, which is to earn fees come hell or high water.

    We will give notice, but haven't decided what to do as of yet. Should I give one month notice or ask to go on a rolling month. If we went on a rolling month. Do we have to pay admin fee's??

    At the end of a fixed term you can renew your tenancy (fees will be charged) or you can choose to go onto a periodic tenancy (no fees can be charged.

    * If you give notice, you must move out (or pay double rent).

    * If you leave at the end of the fixed term, you don't have to give notice, so if you decide to do so (helpful!), it can be a month, 2 months, a week, whatever.

    * if you stay one day extra you create a SPT (see link) - this is automatic by law so no fee can be charged

    * if you stay one day extra you create a SPT (see link) and can then only end the tenancy in line with the monthly (or weekly, quarterly) periods.
