Song, it is better for you to read newbie thread first and foremost and then if you have questions create your own thread. (See my signature).

However if you follow all the advice in this thread, at each stage it has been okayed by regulars so is a good example to build your appeals on.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

Having received a similar notice as OBAone, is there any view on appeal letter OBAone sent to get immediate cancellation from APCOA.
Almost unheard of - but cancellation by POPLA at the second appeal stage is a certainty v APCOA on this forum! READ THE TOP STICKY THREAD FOR NEWBIES PLEASE.

Might be better to drop OBAone a PM - not been on here for a few days now. Just an extra option for you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Hi Spjh,

APCOA (as expected) rejected my initial appeal and supplied a POPLA code. With this I was able to lodge an appeal with POPLA. Then some weeks after I received APCOA's evidence pack. Following this, I sent in a rebuttal to counter all the claims APCOA made.

Finally, on the 22nd August I received a decision from POPLA that the appeal be allowed!!!

You can read the full assessor's determination which I posted in the POPLA Decisions thread here: https://forums.moneysavingexpert.com/discussion/4488337

    Hope this helps.

On the larger stage it's a pity the assessor didn't consider APCOA's fictitious costs schedule, but instead correctly spotted that there was no initial loss hence all the costs of pursuing the non-loss were bogus.

Guess we'll have to wait for a railway car park non-payment case to see what PoPLA makes of APCOA's current utterly inept GPEOL schedule.
