Help please private parking ticket

I'm looking for some advice about a parking ticket I received from NCP. After an initial search of this site I decided to ignore the ticket and wait for them to contact me. It was only later I realized that the advice had changed on ignoring tickets. They are a member of the BPA and they contacted the dvla to get the registered keepers details. A letter was sent to my address but the name on the letter is incorrect. They have addressed it to a Mr O..... coupled with my surname. I am wondering what to do in this case. Should I write and explain no such person exists? or will that just give them time to correct the mistake? As I can prove i'm not Mr O.... should I just wait till further action is taken and then show i'm not that person? They are demanding that under the freedom of information action I must either pay, or identify the driver of the vehicle but as far as i can see they haven't identified the registered keeper successfully. Any advice is much appreciated.

    First advice is to read the Newbie thread at the top of the forum where all is explained.
    You have received the Notice to Keeper, and the keeper should now appeal as per the template in the Newbie thread.
    This will probably get rejected and the keeper will then appeal to POPLA and as the forum has 100% success rate we are confident you will win.

  • I read the info but wasn't sure what to do in this case as the notice to keeper has an incorrect name on it which is why I asked the question about how or if to respond given that the name is incorrect

    First can I say you did do the right thing ignoring the windscreen ticket. It is the NTK that we say not to ignore.
    On the issue of the incorrect keeper being identified and what to do I am not sure.
    I have not successfully searched the forum to see of I can find the right advice to give, but my feeling is to appeal as the keeper giving the correct name, however it may well be that the NTK is non compliant as the name is incorrect, so there may be a different response needed, possibly a differently worded appeal.

    Be patient and hopefully a more experienced member will pop in and give advice.

    I would add to the template usual 3 points:

    no such person lives at this property as is named on your Notice to keeper as 'Mr O xxxxxxx'. I am the registered keeper and I am entitled to appeal to POPLA.




    (But TBH it's a minor point).

    And with NCP at a station you should have sent the appeal straight away as the NEWBIES thread tells you why. You may well find yourself now playing a very silly game of letters exchanged with NCP to get a POPLA code from them. Others have reported all sorts of rubbish calling the keeper a 'third party' and pretending they have to be told who was driving! Even worse, Steve Clark of the BPA Ltd. sided with them. I would be surprised if you get a straight answer with POPLA code, but keep trying.

  • I used the template in the newbies section and added the fact that they had the wrong name on the notice to keeper and I received a letter back saying that they had considered my appeal and had decided to accept it and cancel the pcn! so yay I won!
