Court order for cost domestic violence

Hello all,

Sorry for the long intro.

My partner was involved in an arranged marriage (South Eastern European) for 23 yrs this ended up in physical and mental domestic violence etc.

Anyway, I met her 3 yrs ago after she had been assaulted again and helped her gain the confidence to go to the police and stand up to him, he was arrested, charged, found guilty and sentenced. He was made to leave the property a housing assoc property and an injunction was put in place.

Over the last 2 yrs we have fought to remove his name from the property (even though they were divorced) he refused to give permission to remove his name so we had to go to court. Eventually after 3 court appearances it was found in her favour and the court ordered the change of tenancy and the reimbursement of costs from him to her over £1,200.

This man is claiming to be unemployed now even though he disappears abroad regularly and is seen going to work. he is paying only £7 a week for his 15yr old son from his benefits.

We have put a claim in online have a CCJ out for the court costs and a warrant of control has been issued but we have heard nothing from the bailiffs in over a month despite our best efforts.

He has a nice car, been to the United States over 4 times in the last 6 months and has told his older children that he is not going to pay the money no matter what.

Question is, what can we do now the bailiffs appear to be toothless, We thought they would at least seize his car etc.

Any advice would be grateful

    Chance are the car is on a lease? or HP? In which case the bailiffs cannot touch it.

    getting money out of someone like this is nvery difficult.

    You might be able to make life difficult but that will not get the money.

    Do you actually know what his assets are? Do you know what benefits he is claiming? Some are not paid if you go outside the UK for any length of time.

    It may however be better just to accept that the chance of getting anything are poor. Save your energy for living your new life?

  • The car is bought for and paid for when they were together. He is on jobseekers (even though he does work....benefit fraud)

    he is renting a room in a house, he also took the family savings and had properties abroad changed in his name (different laws there, men are better than women)

    i personally would like to inform the benfit agencies and get a high court order for the money and get the high court sheriff out who are paid on results

    I'd forget the money & move on with your lives.
    He will be loving the fact you can't touch him so take that away.

    Your OH & her son are safe & that is all that matters.

    Enforceability is never easy, particularly with people skirting the grey economy.

    In which case he has to sign off every time he leaves the UK as you are not allowed holidays unless booked with the JC and you have to be in the Uk and prepared to return home if offered an interview.

  • Thank you for the positive help. We still can't believe that a legal institution can chase you for £10 will let you suffer for £1,200 why why do they not want to help?
