Hi i wonder if someone would be able to help me...
I pre-ordered something off a website on the 6th June and was told that what i pre-ordered would be in stock the following week, (it wasn't) but it became available on their website on the 16th.. so i sent a support ticket in asking when to expect delivery and nobody answered for 2 days.. finally i got through to someone and they said that they was making another stock run next week and that my item would not get shipped until tues/wed the 24th/25th .. when i asked why it would be taking so long as they have on their website that they are in stock now and ready to ship as next day delivery i got this reply:
(A refund for your order will be processed within the next 30 days
if after 15 days you have not received a refund back via the method as used for payment then send 1 email only to refunds@mrconsoles.com with the original payment reference and the words refund. Any other messages or emails to this address will be deleted unread.
We have also taken the commercial decision to refuse any future business from you either now or in the future and as a result of wishing to keep the support ticket system available for only present and future customers you will no longer have any access to open new or answer any existing tickets.
Should you have any other concerns you can address them to us in writing to the address upon the contact us page)
All this because i was just wanting to know what was happening with an item i had already given money for
my main question is are they legally allowed to do this after i have given them my money already and do i have to wait that long also for my refund?

Its a bit harsh if all you asked was an update on what you ordered, they are entitled to choose who they do business with though.0

That is interesting. What do their T&Cs say about when a contract is concluded?
Without digging too far not a lot by the looks of it. They look mickey mouse though.

i was not aggressive, i didn't swear, i didn't send any threats..
all i did after them telling me they wouldn't be able to send my item out until another stock run had been made was a question.. why was i having to wait when the item on their website was in stock and available for next day delivery
I have bought the item elsewhere now.. it's mainly the refund i'm wondering about.
As after the message they sent me i can just see them not sending it me back until the 29th day lol..

Looks like their previous trading name was mrmodchips - and that name rings a bell.

just read over the thread.. it's seems to be a common thing when confronted about items that haven't arrived yet, he seems to block communications..
I've also noticed that the OP of the thread you linked me to only received his money back by doing a charge back with his bank.. do you think i should do this now or wait the 30 days?

You can try a chargeback but it may be tricky trying to do it before the 30 days is up.
The reason for this is chargeback can only be done for certain reasons. non-delivery is one but the bank may argue that as the order has been cancelled, chargeback for this reason is no longer available.

been in touch with my bank and they are sending a form out for me to fill in for the charge back. And they said that there would be no problem doing the charge back... thank you so much for your help.. very much appreciated
