Ebay new item broke under warranty

Hi all,

Was having a look through Ebay and found a brand new, still sealed product. Was on "Buy It Now" or best offer, made offer, was accepted and payed cash on collection same day.

Came to use said item and within an hour it died. Messaged seller who advised it was still under warranty from retailer and gave me all the order details. Great!

I rang the retailer the next day and gave details, they arranged collection of the item to replace/repair under warranty.

A week later I chased them, to be told the item is out of stock so they have issued a refund to the original card used to purchase it (the guy I bought it off).

Contact seller again, advised what the retailer said and he advised he was going to refund me via Paypal.

This was back on Monday, sent another message but have so far not received a response. I understand it gets a bit tricky because it was cash on collection, but would Ebay uphold a complaint against him given that he has in writing told me he would refund via Paypal?

    eBay can't enforce a refund because you paid by cash. They won't get involved with it at all.

    How long ago did the retailer advise they they were going to refund the original buyer? It may be that he is waiting for the refund before refunding you.

    Ultimately if he refuses to refund you can take him to small claims court, as you have evidence of everything you should win. I doubt the seller would let it get that far though.

    I thought that would be the case. I'll give him another week, if nothing then may open a dispute on ebay. Hopefully this would nudge him to fork out, and if that fails, small claims court!
