messed up?

New to this forum. I have just sat down to sort out my paper work for court hearing on 1st August to reclaim over £3000 in bank charges and realize I have made a horrendous mistake and all the paper work should have been in 14 days after the court letter was sent out, not 14 days BEFORE the hearing. I am new to making court applications and I am gutted that i've made such a STUPID mistake. Have I lost totally, or is there anything I can do?

  • As far as I could find out today from my local county court there are no documents to be supplied. These should already have been handed over when you lodged your claim and anyway there is only bank statements showing your charges and your bank should have them anyway? My problem is that my hearing date is 27th July and I have no idea what to do or who to contact? My claim is with Barclays. Can anyone put my mind at rest as to what should happen next or who I should approach at Barclays?
  • The letter I received states that all copies of the statements need to be sent to the court as well as to the defendant although you are absolutly correct, the bank do have copies as they sent me all the computerised statements and I have also previously sent them a breakdown of the charges I am reclaiming. Thanks for your reply anyway. Good luck!

Phone your court and ask them if you can get them in now.

and both of you need to read the Court Bundle checklist thread...

    http://forums.moneysavingexpert.com/showthread.html?t=493178&page=8

This tells you exactly what you need and you need 3 copies of this, one for the court, one for the solicitor/bank and one for you to take to court.

Make sure you read MimiJane's posts in the above thread as she is the expert there and read the thread relevant to your bank, you'll find them all linked in the Reclaim Help Thread, as there you will find the experiences of others who are at the same stage as you both, don't panic!
  • I can't find the forum thread for A+L, (to be honest i'm finding this forum malarky very difficult to navigate!).As for the cout bundle..where does it reside? I have looked at the thread you send but get stuck after that.

The link for both threads can be found in the Reclaim Bank Charges Help Thread, the link for which can be found in Edinburghlass's signature. It really is a must read.
    Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH
  • Thankyou for that. I have had a look at the letter etc on the link and I'm more confused than I was before. There doesn't seem to be any similarity between the letter i received from the court and whats on the link.
I'll call the court tomorrow.....maybe the claim can be deferred for me to get the paper work in order? Who knows..
