    Not the legal system at fault, the competency of the Defending insurers and their solicitors.

    Not blaming the legal system, just said its unfortunate. In other jurisdictions the judges job is to probe and spur investigation etc where as ours simply judge based on the evidence presented
  • The evidence follows from the pleadings, if you don't plead your case, you can't pull rabbits out of hats on the day.
