Delivery agreement dispute

I contacted seller BEFORE buying plants to see if they would delay posting them for 2 weeks as I was about to go away on holiday. They agreed and asked that I add a note to the order as a reminder to them.

I added the note and paid for plants. On arriving home from hols, in the pile of post was the "tried to deliver parcel, please collect from PO". All plants were well and truly dead and delivery details show that they were sent immediately after payment was received.

Contacted seller who's only response was "you didn't add a note to the order".
Is there any way I can access this order + note or is it going to be a case of my word against his?

    How did you order from (ebay, website etc) and how did you pay for it?

    paid by usual (Buy it Now) ebay system. Added note to contact seller box and confirmed Paypal payment.

    Personally, I would open an ebay or paypal dispute for goods not received.
    As your seller won't be able to show delivery, you should be refunded in full, and you could always ask ebay to look at the message that you sent.

    You'd commit fraud and boast about it on the internet?

    Is that would you'd really do, and is the advice you want to be giving?

    To the OP: ignore this post, simply go to your Paypal payment, and check you did indeed a a note (in 'notes to seller') which will be visible below your payment. Remind the seller of this, and ask for a refund. Don't steal from them though!

    Not only is it committing fraud, but it could well end up in a fraudulent claim against the courier for the loss.

    My mistake.

    I read the opening post and took it to mean that the OP didn't accept the package at the delivery office as they could see that the plants were knackered.

    In that case, a SNAD dispute is what is needed.
