Bought a new car

Hi,
Please can someone help with an issue I have. I bought a second hand car from a private seller yesterday, advertised with 12 months MOT and tax. I checked the MOT (which is correct) and looked at the expiry date of the tax (05/2015).
I paid for the car and returned home.
I noticed today that the tax disc states 'disabled class' and the fee was free. I now have to put the car off the road, wait for the log book, send it off with the tax disc and payment for a new tax disc - this is going to take weeks, if not months knowing the dvla. So I am without a car while this happens.
Can I make any claim against the individual who sold me the car as he never mentioned the car was in a disability class and that I would need to change all of this and that there is actually no tax with the car, even though advertised with 12 months. Can this be done through a small claims court?

"It depends" ... on precisely what was advertised, and whether the seller was obliged to bring notice to the tax classification. (A business seller would have to, I don't believe the same applies to private sales - here all that matters is that what is described is accurate).
To be pedantic, the vehicle did have 12 months tax on it, just not for an able-bodied owner.
In the grand scheme of things, you had the opportunity to view and inspect the vehicle prior to purchase (including the tax disc), and proceeded with the deal. So unfortunately I think this is just Caveat Emptor.

According to this https://www.gov.uk/car-tax-disc-without-v11-reminder you can get tax at a post office without a reminder or log book.
So, no losses, don't need to worry about court.0 -
Unfortunately, after reading online, it is likely the log book is in the disability exemption class (otherwise he would not have got disability tax for it). IF the seller sends off the logbook then it will arrive still as a disability vehicle. I cannot go to the post office to get the tax with the green new keeper slip as it is registered as disabled.
Whether there was tax or not, I would not have known to check whether a car is in a disability taxation class or not, I do now!
So I am out of pocket just over £300 on top of the cost of the car, plus I need to hire a car for the next few weeks until I have my new logbook and sent it back to be changed to PLG, not disability.

Took me one day to change a disabled tax disc to PLG via a main Post Office .Absolutely no need for the car to be off the road or SORN.
You should have received the bottom portion of the log book /registration document that would enable taxing and changing the licence class at a main post office .0
