Letter from DRP ltd, re. EXCEL Parking services

Please can someone help me?
I have today received a letter stating we apparently exceeded the maximum parking period permitted on 4.2.2009?! They want us to pay £100!!!!!

Can they write to us after this long?

I googled DRP Limited, SK14 9DD and it is a debt recovery and the letter threatens that they'll recommend that the creditors solicitor take us to court!
The letter also begins that Excel wrote to us "recently".... Except they didn't! They say that's why it has been referred to them.

I am really scared now, should I disregard it as I have been advised by friends?

    There is no keeper liability before October 2012, so as they don't know who the driver was, there is nothing they can do. You are safe to ignore.
    Read the Newbie thread and all will be explained. It is a speculative invoice and not a fine. If you should get a similar letter for a parking incident after October 2012 then the advice would be different.
    You may get a few more letters but just ignore. There is nothing they can do. File then in the filing cabinet starting with B. Or keep them somewhere and see how many you get for a laugh and see how much it would cost to send them to you. The more you get, the more out of pocket they are.

    But Do not contact them or be afraid of their very empty threats. Think of them as a weasel trying to threaten a crocodile!

    They can pursue up to 6 years after the supposed "offense". But that doesn't mean you have to pay.

    There was no registered keeper liability back then, so they have no grounds to take you to court. All they can do is pester you by mail, so either just ignore them or write back saying that you dispute the debt and ask that they pass it back to their clients.

    I personally wouldn't write back as you really do not want to enter into a chain of correspondence for a letter regarding something from 2009. They know there is nothing they can do.

    Just trying it on. Ignore them. Any contact with them at all will tip them off that they've got a "live" one so they will harass you even harder.

    I phoned the BPA too just now for advice & there's not much they can advise at this point.
    I was hoping it is not something they can enforce, particularly after all this time anyway...and to go straight to threatening court is disgusting!

    I think maybe with the 6 year rule thing that they are just going through old "unpaid charges" and found our details & thought they'd try their luck?!
    I think you are right about contacting them directly though, they might just pursue more aggressively.

    You are still taking it too seriously. Phoning the BPA? That's like 'phoning Dracula to help you with high blood pressure.

    Just file and forget. They will give up again after another few letters.

    hmm , let me see , problem arose in feb 2009

    its now june 2014

    2009 + 6 years = feb 2015

    statute of limitations = 6 years under the small claims court procedures

    POFA 2012 is after 2009 so cannot apply

    DRP cannot issue court proceedings

    nobody knows who the driver is so the actual creditor cannot issue court proceedings against the (unknown) driver

    are DRP trying it on with very old cases ? - yes (otherwise they wont get paid)

    IGNORE , seeing as you have done so for 5.33 years and only have to wait another 8 months

    its a fishing trip !

    There were at least two other cases on here like that only at the weekend, easy to find if you search the forum or just skim back a few pages looking at thread titles. May take 30 mins but you will find them.

  • O can beat this, today I got the same letter from DRP, and my parking was 15 NOv 2008 - A Demand for unpaid payment and none payment; "we will recommend to creditor's solicitor that court action should be taken to recover money owed!
    Just give me reassurance and tell me I am right to ignore!

    They are obviously having a last go at some real oldies just before they become statute-barred. A few mugs will pay up. Don't be one of them.
