Conservatory built over open gully

Hi all - looking for some advice please? I had a conservatory built over an open gully. The paperwork from the company advised that they should 'cap off' the gully. I don't think this has been done.
We have a really bad smell in the house and after get a drainage company out they have advised that they think there has been a blockage, and that water is pouring out of the top of the gully into the space under the conservatory.
I don't even think something like that would be covered under the house insurance. But my question is:
Does/Did the conservatory company have any legal obligation to cap this off; or is it a nice to have?
