If I were you I would write to Lesley at that address and tell him/her that:
- you would welcome the issue of court proceedings and you look forward to seeing how he/she identifies themselves in court given that he/she has failed to properly identify themselves as required by law on their signage or correspondence to date, and how he/she will explain to the court these breaches of company legislation, and in the meantime:
- you are reporting him/her to Trading Standards for those breaches of company legislation
- you are complaining to DVLA and ICO that your personal details have been misused and you are requesting from DVLA a copy of the data request they received from "CPMS".Je suis Charlie.0 -
My dad's the registered the keeper and the one who is addressed on the letters and emails...
Thanks for the advice! Think I will put that as an email rather than a letter - I'm worried about writing to a home address (despite CPMS allowing the very same thing to happen!!!)

So do I not need to send the letter asking for a POPLA code? And after sending the email concerning the company legislation etc, is it an instance when it's ok to ignore any future letters?!

Up to you really. I don't think he's going to give you a PoPLA code because he's saying that you are too late to appeal, but you can ask. You can cost him £27 at PoPLA if he does.
If you tell him you were the driver then he should stop harassing your Dad and chase you instead, whereupon you can just ignore him. Whether he actually will stop chasing your Dad, who can say?
The idea of the letter pointing out all his shortcomings is to persuade him that you (and your Dad) are just too indigestible to be worth chasing. Additionally you could contact the proprietors of Manchester Science Park and explain to them what a cowboy they have got into bed with.Je suis Charlie.0 -
There is nothing whatsoever to prevent your company from accepting an appeal at any stage. I am aware that in many cases in the public domain, private parking companies have issued POPLA codes much later than your self-imposed 28 days guideline and indeed POPLA have confirmed that a code can be issued by the operator at any time.
Refusing access to your industry's alternative dispute resolution procedure would be unreasonable and a breach of the Civil Procedure Rules, as well as evidence of CPMS failing to mitigate your alleged loss.
As far as I am concerned, I have made a valid challenge. If I do not receive a clear rejection, along with a POPLA code within 35 days of today's date, I will regard the challenge as accepted and the matter closed.
Furthermore, concerning court proceeding threatened by agents acting on your behalf, I look forward to seeing how you identify yourself in court given that you have failed to properly identify yourself as required by law on your signage or correspondence to date, and how you will explain to the court these breaches of company legislation.
In the meantime:
- I am reporting you to Trading Standards for the aforementioned breaches of company legislation

Looks fine to me, except you haven't told him you were the driver. You need to do this to stop him chasing your Dad.

Yes, given that your main objective is to stop them writing to your Dad. Can't see this going to appeal and it certainly isn't going to court, so it doesn't much matter for any other reason.Je suis Charlie.0
