Used Car Brake Issue.

Hi all,

We got a used car 3 and a half weeks ago. Now the brake is 'sticking'. We haven't had it checked yet. We have a warranty that doesn't cover pads/discs/cables etc which we are fully aware of, but if it is one of these items, would the sale of goods act help?

I know 'wear and tear' items like pads etc are sort of a 'pot luck' thing but obviously with it only being 3 1/2 weeks old, seems a bit rubbish if we have to pay already!! I am prepared for the fact we might but wanted to try here first to see if there is any hope!!

Edited - meant to say, not sure if relevant but was bought from Evans Halshaw and is 3 1/2 yrs old.

Thanks in advance.

Was it a used car under one of the manufacturer approved schemes . These usually entail a listed vehicle condition and rectify check before sale .
Plus as above as in what sticking on off or after parking .

Erm, that would be Mr Anon's dept. He said when he takes the handbrake off, it is stiff and then sort of loudly clunks. Kind of a bang.
I know we will need to find out first what it is and there is the chance that whatever it is, it is covered under warranty.

If it's not then it will just be the wear and tear stuff which we acknowledge we might have to pay for.

I don't think it was sold under the manufacturer approved scheme. EH were pretty useless to be honest, saying they had done stuff when they hadn't so I imagine that whatever this is, they will be just as awkward which is why I am trying to ascertain whether this is worth fighting if not a warranty covered issue.

Careful not to drive it like such as if the brakes still applied it can overheat the bearing.

Is it disc or drum brakes at rear?
    Front or back sticking?
