Hire Car - charging for releasing details to a PPC

Car hireco charged me for releasing my details to a PPC [private parking company] for a 'ticket'.



Ticket was later withdrawn by the PPC.


I'm taking the hireco to the SCC for return of the charge.
Can anyone help with previous case details or similar.

What did the contract T&Cs say? I'd bet they only talked about fines and penalties ... a private parking charge is NOT a fine or penalty. Therefore they're likely in breach of contract ... raise the charge as disputed with your card provider?

Yeah that's the tack I'm taking [not a penalty].

Previous cases for what?

Unless its been at a higher court (higher than small claims) there will be no precedent set.

Perhaps as above poster suggests, scrutinise your T&C's? Just remember that it being in the T&C's doesnt mean its legally enforceable (unfair terms for example).
