I think the government actually need to sort this out - telling tenants not to inform LL's, of receiving HB, which, in turn, may have an impact on their mortgage, seems a funny way of carrying on.
Lin
I don't think the government has actually told tenants this.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. It gets worse ! LLord bought the property using a 1st time buyers scheme (reduced price etc) and his mortgage is linked to that. He lived there for 12 months but then got offered a job away. He was then a bit stuck as to what to do as, in theory, he couldn't let the property and he wasn't sure whether he would stay away or not. He couldn't live elsewhere and pay the mortgage on an empty property.
So he ''quietly'' let it to my son (and partner + baby) for a figure including ALL bills including utility, sky, bt etc etc so that it appeared the owner still lived there. Tenancy agreement is in place in son's name who is aware of the overall situation. The agreement is in place really to cover repairs etc.
LLord/Owner is basically worried about any link between HB claim and the legality of the let in that he could face financial penalties if it was found out. ?? He's not concerned about the rent not being paid because he knows it will be (I'll oversee that) and I've already worked out that HB is less then the rent but the next 2 months rent is being funded privately and any shortfall beyond that, if it goes to the HB route, can be covered privately.
Not sure what to tell son/partner now ?? or how to approach LLord. My major concern is the little person who is adorable.
I did get a nice fathers day card though.:)0 -

Sounds like the LL is letting out the place illegally full stop, HB or not.
The HB is only an issue because LL is worried it will mean he gets caught.
Simple way to sort this out, tell LL that HB payments are none of his business.
Either he accepts the rent or if he issues notice, then you will report this both to his lender and those who administer his scheme.
I get a funny feeling that this is a shared ownership property.
This is the LL's problem, not yours0 -

The LL is not behaving illegally - it's not a criminal offence, although it may well constitute breach of contract.
However, to threaten him in the way suggested is tantamount to blackmail. Even if you mentally think you'll report the LL as you see fit afterwards, threats shouldn't come into the decision making process and hardly make for a decent future relationship of any duration.0
