Orange debt from 6 years ago.

Options
I had a debt from 2008 from orange and I recently asked for a credit agreement because I now have a CCJ On my credit file which was put on January 30th 2014.
1. They say a phone contract is a service agreement not a credit agreement is this true?
2. The letter says the balance has been litigated but remains due and payable what does this mean (I'll upload a photo of the letter)
3. If I pay it will the ccj be removed based on what the letter is saying?

Thanks.

  • It won't currently let me upload a picture so I'll write it out.

"This matter relates to an internet everywhere 24 month 3G contract opened with orange on 29 July 2008. The account defaulted in October 2009 and was subsequently assigned to capquest.

Legal action was issued on a balance of £299.99, and judgement was entered on 30 January 2014. To minimise costs, the remaining balance on the account has not be litigated on but remains due and payable. Interest is not currently being added to this account.

As this is a mobile contract there is no credit agreement available, only a service agreement which can be provided by the shop the item was purchased from. In this case the store is listed as I-shop.

We are currently liaising with orange to obtain a statement of account. Once we are in receipt of this we will forward it to you."

I can only answer 1 and 3, which is Yes and No.

Airtime contracts are considered service agreements and a CCJ would only be removed if you had paid the judgement within one calendar month.
