POPLA appeal rejected - what next?

Hi,

I recently appealed against a parking fine on private land on the grounds that the signage was not adequate and was too far from where I parked, I suggested there should be a sign posted behind the bay. The parking company rejected my argument within a few hours of receiving it and so I went to POPLA. Just after I went to POPLA I revisited the site to find the parking company had since erected a sign exactly where I had suggested. I submitted this additional info with photos to POPLA. However they rejected my claim saying the original signs are adequate. Since then I have ignored the parking company's letter and have just received a letter from newlyn debt collection ltd, the fine has gone up £54 and they are stating that further action will be taken at considerable cost to me.

My instinct is to ignore them after reading some of the posts on this forum. Anyone got any advice to bolster my confidence?

    The advice is definitely not to ignore if you are in England or Wales. It is a shame you did not find this site earlier as you would not have failed at POPLA.

    Read the Newbie thread particularly posts 4 & 5.
    Who was the parking company?
    Come back after you have read this thread several times and try to get your head around the next stage, then come back and ask for further advice if needed.

    Search the forum for Newlyn to read loads of threads from people laughing at them.

    Tell us which PPC it is and we can tell you if they try small claims or not.

    So is it still down to the par king company to decide to go to small claims as the letter from newlyn states that all comms should go through them?

    I have now read all the threads so thanks for the pointers. I just want to check that the letter to the debt collectors is the correct action even though I had a POPLA appeal turned down?

    If so I will send it off immediately.

    The letter to the debt collector won't make any difference and personally I wouldn't bother! Unfortunately PCM might try court and the letter you should respond to would be the Letter before Claim from Gladstones. Search the forum for 'Gladstones' as a keyword to find other threads about them sending a LBC and how to respond to a LBCCC which is also in a sticky thread all about it (hosted by Crabman third thread from the top, entitled something like 'parking stickies').

    What a shame you didn't research earlier how to win at POPLA. We don't lose - and you wouldn't have lost if only you'd said 'the charge is not a genuine pre-estimate of any loss' and other stuff about them not owning the land, etc. Never mind, too late now and at least we know if you do have to defend at small claims then you have a case - basically the stuff you should have said at POPLA stage! And we can help if it comes to that. Newlyn are nothing, I would ignore them.

  • Thanks to all on this site who answered my initial post. I read the posts recommended and acted accordingly. To date I have heard nothing further on the subject. Last letter from the debt collectors was in June. To anyone who is thinking about paying, read the posts on this site, and hold your nerve, you can make these people go away.
