Bank Charges Repayment If Owe Bank?

I am no longer an account holder of my bank as they have stopped my account. I did have a loan with them but failed to keep up my regular payments, I currently own them £2,500.

However, I have gone through the process of reclaiming my bank charges, which I was hoping to pay them back with this amount, totalling £4,300. The bank have failed to get in touch with me regarding this so I am therefore at the stage to take court action.

Do you think I would still win the case given my circumstance i.e. I owe them money?

    You owing them money will not influence the outcome of the court case, but they will offset reclaimed charges against any money you owe.
