    Why doesn't your sister just change the locks?
    Then she stops the LL from arranging viewings when he wants and makes it much more difficult for him to sell. Then after making herself such a pain in the A that she'll probably get her S.21.

    Thats just another non advice opinion which if u read the first post and the longer further explanation the complexeties of the situation being that my sister wants notice serving but the council originally said that if she allowed this to happen she would be making herself intentionally homeless due to her rights in the contract and there being no break clause. Her ll wont giver her notice or serve a sec 21 until the house is sold. Thats the ll trying it on in bad faith. Wanting someone else to pay the mortgage until the point where the house is sold. Thats the main problem. They have even said to her face that they cant afford to pay the mortgage if she moves before the house is sold.

    I suppose she could be a pain and change the locks etc. But at the moment she is seeking to do this amicably. She has no bond to worry about etc and she has allowed viewings at certain times that suit her. She could be a real pain and wait for court action to remove her. But shes not that kind of person. She just wants her notice so she can have a decent shot at a council property thats more affordable.

    So your thread is not about, an ambiguous contract term, not about notice periods, not about LL rights to let themselves in.


    It's all about your sister wanting to wangle a council place.

    Sorry but in the masses of text i've lost the actual question you're asking.

    The LL has stated his position that he will not give an s.21 until he has sold the property.
    Your sister doesn't want to do anything to 'persuade' him to do it any sooner.

    If my understanding of this is the correct, then there really isn't anything else to be said.

    Wangle? Is council housing not set up for familys who cant afford private renting. U cant win on these forums. Its either not enough info or too much. The op was for info as to whether the proposed break clause could be used. I got accusations of trying to diddle the landlord etc amongst a few real answers from such as GM. I pointed out that my sister wants out so she can be nearer family. How the ll was being unreasonable etc. Theres a difference between being unreasonable and being a git about it. It is about ll rights to let themselves in theginge and also about legal notice periods. Too many keyboard warriors on forums these days. Its poibtless asking anything. As i said in my op i didnt want opinionated snyd remarks. Yet u still get them
