I think the word 'expressly' is key here, which I take to mean explicitly. Terms and conditions on the website are implicit acceptance in my opinion so don't meet the express requirement, and they are also not durable. I would hope that to give credit instead of money the retailer would require written acceptance.
I think that is a big flaw with the CCR's though. It needs to be much clearer to close loopholes like that if it wasn't intended.0 -
I'm going through the same process. Bought a coat on the 13th December, paid by card. Sent it back and they said that they refunded on the 31st December. When I checked my account, I had not received the refund. I then checked their online account and realised that they gave me online credit excluding postage. I asked for the money to be transferred to my account and they are still insisting that their T&C were clear and they expressed clearly their policy. Phoned the Consumer Advice Bureau and they said that items being on sale does not make a difference to my rights. Now I'm not sure whether i should send a letter of complaint to the company or claim through my card of payment.0

You received the goods on the 13th, but when did you send them back?
Also, did you return everything that was delivered or did you keep some things?0 -
I ordered on the 13th, have an email saying that it was dispatched on the 15th. I'n not sure when i received it, but I know that I sent it back through tracked mail before the 24th December. They must have received it by the 31st because that's when they said that the refund was done.
I had bought only one item.
They are clearly using their returns policy as a get out of jail card. I will proceed with filing a claim through my bank. Is there a way where these companies can be blacklisted?0 -
I have written to Apricot and emailed several times and they stand by their t and cs. I have also tried my credit card company who advised because it's in there t & cs they can't help. So I'm now forced to buy from them. ��0

My bank just said the same, since it's in their T&C, they cannot do anything. So basically, this company is getting away with murder. Really annoyed with this... will only buy to make use of the credit.0

I've just had the same issue also and I've been in touch with citizens advice. The law says that you should have a full refund (not credit note) for items returned within 14 days. They have advised to write a letter to resolve but they are referring the matter to trading standards. They said they will only be able to take action if they receive a number of complaints so if you feel strongly enough then you need to get in contact with your local citizens advice. We can't let them get away with this.0

I had phoned the Citizens advice bureau and they said the same. Bank said that they can't give me the money back, so i ended up buying something else, didn't like it and sold it on ebay at a fraction of the price. This company is not worth buying from.0

I have just had this email from one of the directors at Apricot. I mentioned to him that his company were not following DSRs and linked him to this thread. According to him they are reviewing procedures, although I cannot see how they have been able to get away with it for so long. Will update on here if I hear any more.
Thank you for bringing this to my attention, we are currently reviewing our processes on this matter. I will get back to you very shortly with the outcome of our review.
