Item not as described, what do I do now?

I purchased a t-shirt off eBay which was describe as 'good condition with no defects'. It arrives yesterday and it has two holes either side of the seem at the bottom.

I sent the seller a message and opened an item not as describe case, but he seller has asked me to send it back for a refund minus postage. (So I will lose the amount I paid for the initial postage plus the cost to send it back).

Is there anything I can do or should I just send it back and lose the £4, when the t-shirt was only £5!

Thanks

If you have opened a case then the buyer will have no choice but to refund you in full including the postage that you paid. Regardless of what they say. Do not let the case close until you get every penny you paid back. You however can't force them to refund the return postage.

If it is a thin t-shirt and you fold it right you can get away for a large letter. Do not forget to send recorded so there is no danger of it getting lost in the post. Don't forget the feedback about how the seller responded.
