Always been PAYE

in Cutting tax
Dont know if anyone can help.
My wife has always been PAYE but earlier this year she received a notice to submit self assessment for 2012/13 it has now got to the point where she has been fined 100 pound for late submission and is probably on the £10 a day period.
She has tax coding notices from employers for the period concerned, but because she is a Teacher and her employment finished August 2013 and then we moved home and she didnt work again until february 14, she has obviously popped up on the radar. Now they have asked for a self assessment for 2013/14 even though she is once again working in a school with PAYE.
She is going to ring them today and discuss it.
What is the likelihood of them quashing the charges if she can prove that she was under the impression that tax was being taken at source?
At present with our calculations of the (not very well explained) charges system she is currently at approx £400 and rising by the day

2012-13 Self assessment should have been submitted by 30th September 2013 on paper or 31st January online.
You say she recieved notice earlier this year for a return. This would had included the submission date. As you missed this date the fine is automatic. Continued ignorance I am afraid will not wash with them. As you are now being fined £10 a day, this suggests that the ignorance has been going on for a while.
One hopes OPs wife does not teach reading and writing.0 -

Very helpful person you are.
To the op, it shouldnt have flagged if it was just a gap in employment. Does she make any other income or liable for CGT?
All you can do is provide the evidence and hope that they agree it was a mistake in asking for the self assessment. Even if it was a mistake (not strictly necessary) they have still asked for one. By not contacting them to query it its accepted that you will abide by the submssion dates.
Good luck with it.0 -
HMRC website.
£100 fine automatic on late return. Then £10 for ninety days after three months. Fine stands at £400. This suggest submission date was 31st January. It us now June. I suggest OPs wife does her tax return sharpish.
Although HMRC allow appeals, continued ignorance of submission will not bore well.0 -

You seem to be under a misaprehension as to the nature of PAYE and tax returns basically there is none. If you are employed then your employer is legally obliged to deduct tax under the rules of PAYE. If you have any untaxed income then you should tell HMRC usually by means of a tax return. If HMRC ask you to submit a tax return consider it to be an order.
A tax return is a bare your soul document, you have to tell them everything. It is quite possible that your wife owes tax which can only be collected by PAYE through a tax return which reduces the code number. This would happen if your wife had a taxable earnings over £41,865 and had savings income, interest or dividends.
There are other reasons and you should complete the return ASAP and submit it with a letter apologising for the delay and hope you are dealt with by a simpathetic officer. The only thing that is constant is change.0 -

But the request for submitting was dated 30th January !
So they gave her 1 day !
Since then she has had 2 different tax PAYE codes sent to her for the full time job she does.
Which is by the way teaching kids who come out with smart**se comments
She wont actually know if she is fined a daily charge until later as there is a small print that details 3 months late and then the charge implements, but the payment by date on the 100 pound fine is not for another 2weeks yet0 -

Was that the REMINDER not the original request.
Why do you not just submit the return? The only thing that is constant is change.0 -
it was the Original request and she also had a new tax coding notice dated the same day which came in the same envelope which stated that the new employer would be deducting PAYE using this code.
No other income (barely enough 1st income)
I think we shall get on with it tonight.
If she gets any explanation later today then I shall post again tomorrow0 -

Why do you keep refering to the PAYE codes they have nothing to do with your situation?
Finish it tonight. The only thing that is constant is change.0 -
OP your wife is currently running up a fine of £10 per day. Your continued ignorance is not changing this fact.
If the original request was dated 30th January, your wife would have been given an extension to the deadline to complete her return. As the fine is in excess of £400 now it suggests she got notified last year.
Thanks for suggesting that the sun really does shine in my trousers. It helps.0 -
There's definetly is BoP
Did you mean definitely?
