  • OP, you need to talk to your solicitor about purchasing a property with tenants in situ. It's not enough to have met them and found them to be "nice".

    Until your solicitor has clarified this situation with the vendor, there are only going to be more delays and hassle, and costs incurred by yourself. Everything else is a side issue at the moment.

    I don't think anyone suggested ignoring the calls completely, but firmly telling the EA to call your husband instead and refusing to answer any further questions would've done the job. Hopefully they've got the message now :)

    I am the named owner of our home, but when buying it the EA would call my husband from time to time. He was aware enough of what was going on to either answer, or take a message and help to make sure I was aware. I think telling them to just 'go away' is only going to antagonise things!

    And regardless of the reason, if I was a seller and the buyer hadn't even decided on a lender after 4 weeks I would have completely lost patience. If the appointment wasn't available for 4 weeks, then that isn't the mortgage for you! You have to be proactive, or take a long lunchbreak and sort it out. Or ask your wife to go and do the meeting and take all the documents for signing to you... or basically... find a way!!

    My husband doesn't have the option of taking a long lunch break, and he doesn't drive so it would take a good while to get to an appointment. He'd have had to take at least half a day off, which seemed pointless when he had managed to book an appointment that was only three weeks away - not especially long, and it left him with that additional half day off for when the baby is here.

    He tried to sort a mortgage over the phone but the person didn't get back to him after he'd spent an hour discussing what he was looking for (he tried ringing on several occasions but only ever reached her voicemail), and he'd decided to go with HSBC weeks ago - he was just waiting for the appointment to put the application in. We told them when the appointment was - if they'd had a problem, they could have told us then.

    He's been in touch with them and discussed the problems, and the fact that the solicitor is off until Tuesday now. He didn't realise that it was the solicitor's 'policy' to not do searches until after the mortgage had been sorted, which is why he paid for it weeks ago.

    Not sure what was said about the tenants still being there but I know that he is concerned about it so will make sure something gets done.

    Three weeks is a long time. He should've taken the half day and got it sorted as quickly as possible.

    As I said, as a seller I wouldn't be interested in why you are being delayed, just that you are. Why should it be the sellers problem that you can't take a half day to sort out a mortgage? Why is it their concern that your prioritise half a day with a sleeping baby over getting a roof over its head?

    It's not their concern! Its your problem, and no reason they should make it theirs. As I said, I'd have moved on long ago. You are being unreasonable.

    While I can see why the house might be going to be in your husband's name (that's your choice), I don't see why the EA shouldn't expect you to be part of the decision-making process. You're a couple. Didn't you decide on this house together?
