    I don't believe you. The bank has no legal ability to gag you, and the idea that they'd try to do so is preposterous.

    Wow, that's really annoying for you.

    Given that what you have described as a very serious allegation of fraud, your first port of call would unquestionably have been the police. Forging signatures would almost certainly result in a custodial sentence for a financial professional, even as a first offence.

    But I guess if they've told you you cannot discuss it with anyone other than your solicitor, then going to the police is out of the question. How clever of them. What a brilliant way to avoid a criminal prosecution.

    You say the dispute has been going on for 22 years - so you became aware of this situation around a year after the alleged loan?
    The longer your dispute goes on the harder it will be to resolve - surely at the time you first discovered the alleged fraud the bank were able to provide documentation as to where the money was paid and other evidence to support their position?
    It is a nonsense that you didn't take any action within the first few years, be that through the courts/the police/appointing a solicitor or even the FOS (after 2001).
    We have had a letter from the bank that says (you cannot talk or discuss this matter with anyone only a solicitor.) so we withdrew our complaint to the ombudsman.

    I also don't believe you had a letter to say this, or that it was the reason you withdrew a complaint to the ombudsman.
    As for the deed the first time we new anything about it or saw it was in august 2013,its a total fake but how can we prove it. Many thanks.
    You must surely have sent a subject access request to the bank sometime between 1998 and before 2013, so if the deed wasn't produced previously in response to your request(s) then that could well be a relevant point for the court to consider.

    Is the loan secured on property? Is it registered or unregistered?
    If registered the Land registry will let you have a copy of when the deed was registered.

    HI all. Today 27 june 2014 we recived a deed from our building society,dated 3rd of december 1990 this is a secured loan deed for £10,000 it was paid in full on 5 of april 1991,this is not a copy its the deed we took out,in my previous posts i asked for your help about a secured loan deed dated 5 of april 1991 wich we did NOT take out altho it looks very good,should our building society have sent us the paid off deed soon after it was paid off, or do they keep them until you sell your house or die.If they had sent us the paid deed over 20 years ago, we could have quired the forged deed and would not be in this mess. Any help would be very much appreciated many thanks.

    just to be clear, you're saying someone forged your signatures on secured loan docs in Dec 1990 and.... (this is where I'm getting confused)... either this loan was then paid back in April 1991 (if so why are you now in a mess??) or it wasn't paid back but in all this time no-one has chased you for payments towards it?? Really???


    Also, you've not answered the question yet about when this was first disputed 22 years ago you must have asked the bank for proof of what account the loan was paid into if it was a bank transfer or for a copy of the cashed cheque?? Whose account did the £10,000 go to?? This would have been something very easy for the bank to check at the time...

    So was there one secured loan/deed or two??


    And in your OP you said you did query the forged deed 22 years ago as that is how long this dispute has been dragging on for so did you really query it way back then or not??


    your posts aren't very clear at all and you keep contradicting yourself...

    So 20 years later you are disputing having ever borrowed the money in the first place.
