Car Accident - Is this my fault?

    Hi all sorry will read tomorrow all the comments. Got stuck at work in Wales today so a 14hour day including driving home. Will leave some comments but many thanks to all of you!

    My car insurance policy says any driver over 25 with a full licence can drive my car with my permission. My OH was driving it when he had a minor incident - they both arrived on the roundabout at the same time in similar situation to you and other driver hit him - but he was turning left and the other driver was coming onto it, from his right so it was felt he was in the wrong for not slowing down to see her, even though she was coming up an unlit road and he was in a lit one.

    When the claim went in, the first thing that happened was the insurance company said he was not covered at all, as my policy was for named drivers only. Not so. As I pointed out. Then they said there was an excess of £200. Not so, it was £50, as I pointed out. Then I also had to point out I had a guaranteed discount which included one accident. At every turn they advised me wrong. I suggest your girlfriend reads the policy in detail as it is entirely possible the insurers have got it wrong.

    Nice try, but I think most people aren't quite as half baked as nobbysn*ts and can see through your obvious fake modesty. For the sake of poor nobbysn*ts I'll explain it: by mentioning his qualifications when saying he wouldn't bring them up, Jamie did in fact bring them up. He might not have listed them, but clearly implied that they qualify him and should be given due weight.

    Of course it's probably a bluff anyway :rotfl:

    Well, for your sake, I'll try to simplify it. Jamie mentioned his qualifications as his trump card, I was thinking more of poker.
  • Hi again. I think [DELETED USER] summed things up as far as i the layman is concerned. However, Crazy Jamie has fantastic points to at least help me. I will at least go back to my insurance company with those points if after careful consideration. At the end of the day, still my worst case scenario is... My insurance company walk away from it and just seek costs from the OP for the damage to my parked car. And then my girlfriends insurance company whos car I was driving say they will not open a claim as my girlfriends car was not damaged and then the OP take me to court.

    Also should my girlfriends insurance open a claim and settle with the OP as a named driver on my GF's insurance this would hit her no claims and not mine


  • Ok. Decided just to accept liability. However I like to thank everyone for their input. Especially from the people giving working knowledge of how these things work. And advice on how I might be able to defend my position on a legal/technical basis. I would have actually fought to get a 50/50 split on the accident as I am still quite cross, had my two worst case scenarios not been, either me personally taken to court or my girlfriend getting her no claims affected for a situation I was in, not her.

    Im still quite tempted to write to my insurance company and state my points but not until both mine and OPs cars are repaired and case settled. I dont want this coming back on me later!

    Your GF's NCD will be affected - her policy will have to pay out to the third party even though no damage to her car
  • Hi Quentin... That was the point why my insurance company were holding me to ransom. My insurance comapnt are settling the claim with me driving the other car under DOC benefits which I have on my policy. If I had not accepted liability they would only have acted for me in respect of the third party hitting my parked car. The third party would have tried to claim from my gf's insurance but they would not accept liability (as her car was not damaged) and therefore the third party would have come after me/court.

    Your insurer looks to be unaware at present that you are insured to drive your girlfriends car.

    Because you have that cover on your girlfriend's car then you cannot use your DOC third party cover.

    (Read up in your policy on driving other cars - it only applies if there is no other cover in place)
