Warranty on replacement phone.

In Sept 2012 I got an iPhone 5 with a new contract through Three(3) mobile.

In August/Sept 2013 my battery started to play up. I took it to an Apple Store, who replaced my battery but in doing so bricked my phone, so then replaced the phone. (No charge just a straight swap)

They told me that the replacement device was only covered under warranty for 90 days.

It's now June 2014, my replacement device is displaying a screen defect with a yellow band appearing on one side of the screen. (No damage, it hasn't been dropped etc.)

Do I have any recourse? My original contract/purchase was with Three, but it's now 20+ months from that purchase.

It's 10 months since Apple supplied a replacement.

Does anyone know if I can get anywhere. I'd much prefer it if the "getting somewhere" was with Apple, as they're much easier to deal with, but will resort to talking to Three if I have to!

    Have you spoke to Apple?

    The warranty on purchases runs from the intiial purchase, not from replacement (or you could end up with an infinite warranty)

    As Apple have replaced once, and said it was warrantied for 90 days, you are unlikely to get anything.

    You have had 2 years nearly from the phone, which I would say is pretty standard for phones nowadays, with 24 month contracts etc.

    You could try 3 and Apple, but I wouldnt have high hopes.

    I've contacted Apple, haven't had a response yet.

    I'm trying to establish my rights with regard to sale of goods act etc. and who might be responsible. E.g have Apple taken on any responsibilities by replacing the phone originally.

    As it's a 2 year contract on the phone, a reasonable person would expect the phone to actually last 2 years. It's still 3 months short of that!

    Yes you would expect that, but many things can happen to a phone to stop that.

    You could obtain a report to show that the phone was inherently faulty when you got it, as its over 6 months since you got it. After 6 months you have to prove that.

    As you got it from Apple, but didn't buy it, its going to be tough. Its probably a reconditioned phone if they just gave you it for free.

    Apple did a good thing by giving you a free repair/ replacement phone when you never got it from them. I don't think theyre going to just keep doing that.

    Apple provide a good customer service, yes, but they weren't doing me any favours.

    They're the manufacturer, so they would have to deal with it if I returned it to 3, and then 3 returned it to Apple. Apple are just doing a great PR job buy allowing me to cut out the middleman. It's not out of the kindness of their heart!

    Oh, so you had an independent report the first time the phone went faulty. Just get another this time!

    No, I didn't think so.

    So they were doing you a favour by giving you a replacement phone that is not mandated by the warranty (it probably allows provision for repair), and they didn't take your phone in the meantime.

    Be grateful for the above and beyond service, don't expect it, because that sets up for disappointment

    Don't know what your rights are, but my grandson's iphone packed up, well out of warranty, so, he made an appointment at our local Apple outlet, and for £125 they replaced it, with a new one.

    Pretty good customer service.:T

    The problem the OP will have is that 3 were responsible for the original phone - as the OP decided to take it to the Apple store rather than 3 when it went faulty, they will have no liability over the replacement (unless 3 told them to go to Apple).

    Wasnt the replacement done under warranty?

    If so, easy enough to argue that it was replaced in line with terms of the original contract and thus the replacement didnt breach the contract.
