M&s ppi

1. Following FOS assistance, we have been made an offer via M&S Bank for the period 20/5/2000 to 20/9/11 (when we cancelled the PPI policy).

2. This seems strange because we have not been offered anything for the period 19/5/86 (M&S advised the date policy commenced) to 20/5/86 because in M&S words: "no records are available from the date your policy commenced 19/5/86 until 20/5/2000. The calculation for this period is based on your average balance".


3. Can you please advise what we should do next, either:



a) this is taken up directly by the FOS on our behalf.


b) we write to M&S ourselves not accepting the current offer and requesting an offer based upon the full term of PPI cover. M&S has previously advised PPI was charged from commencement. Bearing in mind the letter states acceptance is to be returned within 6 weeks of the letter dated 6/6/14.

    If the policy started in 1986, that will almost certainly predate FOS jurisdiction over M&S. So if it can prove that is when it started it can refuse to pay anything.
