Contributions based ESA

I have been told I cannot be paid any money due to not enough NI contributions, it is my belief though that I will still have to send in Sick notes as apparently the claim is still classed as 'live' even though I receive no payments?

Does this mean I would still only be able to do permitted work....if I was able to.....and declare it?

    Your claim is still live, yes. Whilst you get no money, you'd receive NI credits for your pension.

    You shouldn't need to send in sick notes. Contributions based ESA only stops after one in WRAG.

    if the OP is on ESA assessment phase then sick notes still have to be sent in order to keep the claim open.
    OP .... do you have a working partner or savings over 16k?

    Yes my partner is working. No savings.

    I claimed ESA from November 2013 to February 2014 when I returned to work, but again ill health is restricting my working ability.
    I guess I used all of my NI contributions whilst claiming before?

    if you paid NI in tax years 11/12 and 12/13 i think you should still be getting conts based ESA.
    if in the WRAG, you can have 365 days of benefit before it stops.
    i would contact them again and make sure they have the correct information

    It is now after the 7th of January 2014.
    This means that a fresh claim of ESA will rely on the last two complete tax years before this time - which is 2011-2012 and 2012-13.
    Any work done (or not) after Apr 2013 is not relevant.
    Were you working significantly as an employed person, in those tax years?
    Your prior claim in Nov 2013 would have relied on tax years 2010/11 and 11/12.

    What date are you claiming from this time around?

    If it is 12 weeks or less from the date your last claim closed (February 2014) then your claims would link and you would be paid again on ESA Conts.

    Yes, you need to send in your medcerts to keep this claim open for NI credits.

    If this claim is outside 12 weeks it won't link and will use tax years

    11/12 to qualify will need to have earned £5,100 or more in this tax year
    12/13 to qualify will need to have earned £5,350 or more in this tax year

    We know you qualify for 11/12 because that was used on your last claim so the question is do you qualify for 12/13?

    You can still do permitted work on an NI credits ESA claim, you need a PW1 form preferably before you start the work, you need to work less than 16 hours and earn no more than £101.00....and you will still need to send in medcerts while doing permitted work.

    I'm confused. In your other thread you said you are fit to work and willing and able to work and empmoyed. The issue is your OFSTED suitable persons certificate. If so how can you claim ESA? Surely by doing so your GP says you are unfit to work, when you are and OFSTED will need to be informed your GP thinks you are not fit.

    The employer should be paying you and long term, how will it effect your claim to OFSTED that you are fit and able if signed off work and claiming ESA?
