PPI mortgage RBS rejection

Hi everyone, long time lurker, first time poster - so please be gentle!!!

We applied for ppi refund which we had on our mortgage with RBS from 1999 - 2006. The 8 week wait was up on Friday there, no response via post so we phoned & were told that the bank defended their selling of the PPI. I asked the reasons, there's a letter in the post which will be here within 7-10 working days, but the reasons they reject our claim, I was told are,
1. I worked more than 16 hrs per week (nurse NHS)
2. The ppi is deemed as "non-advised"
3. Due to the passage of time it cannot be argued that there was pressure on us to take the ppi.

We can appeal to the bank within 28 days & give more information & then obviously go to ombudsman if no joy (as I suspect there won't be).

I was off sick from work for a period of 6 months in 2004 & did not even think about our ppi policy as I got full pay for this time, returned after 6 months as couldn't afford not to, again no thought to ppi policy. Is this new info that would be of any use or is it a waste of time???

Many thanks in advance for any advice

That verifies you are eligible. So, not a valid complaint reason.
    2. The ppi is deemed as "non-advised"

most bank sold MPPI is non-advised. This means it does not have the same level of requirements as an adviser sold case.
    3. Due to the passage of time it cannot be argued that there was pressure on us to take the ppi.

Rare for any complaint to be upheld on that basis. If you had complained shortly after the event, a complaint on this basis is credible. However, 15 years after the event carries no credibility and no chance of proving that allegation

You havent given any real reasons for complaint. A sickness in 2004 does not make it mis-sold in 1999. Most MPPI complaints are rejected by both firm and the FOS. It doesnt suffer quite the level of problems that loan and credit card PPI has. So, seeing as you were eligible for cover it is difficult to see where a complaint would exist.

    Thanks for your reply.
The sickness part of the policy was of no use to us, and surely the fact that I didn't try to make a claim on ppi whilst off sick shows that we did not fully understand the ins & outs of it??
I phoned a few years ago & told we had no ppi on mortgage however someone told me that it is shown on one name, so checked again & my husband had it against his name. I do feel it was mis sold & that we were put under pressure, the phrase PPI was never used by the mortgage advisor, we were told we HAD to take insurance to get the mortgage .

In the last week of the 8 week wait we had several calls from RBS asking us all the same questions which we answered in our written complaint. I got the feeling they were trying to catch us out in our answers.

The sickness part of the policy was of no use to us,

it would have paid out on a claim. So, you were eligible. Whether you needed it or not is not an issue with non-advised cases. Although need would be along the lines of "did you have a mortgage?" and "did you have sufficient savings to cover a couple of years expenditure".
and surely the fact that I didn't try to make a claim on ppi whilst off sick shows that we did not fully understand the ins & outs of it??

What you do or dont do 5 years later has no impact on the sale.
I do feel it was mis sold & that we were put under pressure,
What evidence do you have to support your allegation? The onus is on you to provide proof if they have no evidence to support your side.
the phrase PPI was never used by the mortgage advisor

It wouldnt have been. In 1999 it would have gone under its old name of accident sickness and unemployment cover. That is not grounds for complaint though.
we were told we HAD to take insurance to get the mortgage .

And again, what evidence do you have to support that allegation?
I got the feeling they were trying to catch us out in our answers.

Not likely. They were probably looking to see if you had any factual complaint reasons and not unprovable allegations.

Again, thanks so much for taking time to reply. I will definitely be appealing decision, nothing it lose! I can clearly remember the day we signed and know for a fact we were told it was compulsory. I do feel that the calls were made last week to out pressure on us, they asked exact same questions which were on the complaint paperwork!!

It's possible it was compulsory, as a condition of having the mortgage.
