Payment taken but no goods

Hi All

Hope you can Help.

On Friday 30th May I purchased an exercise bike from Argos via their website. I goat a call the next day advising that they do not have it in stock (even though the site said they did, and it still does) and that delivery could take 60 days. On the 2nd June the payment for the bike was taken!

Considering they have informed me they do not physically have the bike and they have taken payment is this breaching any laws?

    No laws broken, they can take payment, you can either wait or get it refunded.

    When they called to say delivery would be 60 days, did you:

    1. Say you'd wait? In which case they're allowed to take payment.

    2. Say you didn't want to wait, and you wanted to cancel the order. If this, they shouldn't have taken the money.

    It's up to shops whether they take payment at the point of order or dispatch, but which they do should be in their T&Cs.
