Has anyone taken on any of the 4 main banks and threaten to take them to small claims court. And had any sucess.
Unfortunately I became a victium of a scam and not the most sensible thing on the planet to do but I parted with some money though building society account.
After a few weeks I thought something was up and by then it was to late but I report it to my building society and they fell over backwards to help.
Bottom line they had taken any funds out of the account so no money could be recovered.
But the bank in question said that they would close the account down so that this person would not be able to open an account for up to five years.
So I resigned myself to have kissed my money good bye as they had switch off they mobiles.
Well low and behold I got a text giving me the same information as they had con me before .
So contacted my building society and asked them what I should do. they noted my call down so I decided I was going fishing to see if I could land a large two legged fish they asked for me to forward my name so I asked a friend if they minded.
They rung later that morning and he rung back bottom line was they were using same bank account as they had scam me with one initial had changed so much for this bank shutting the account down.
So back I went to the building society and told them and they phoned the bank their reply was they were looking into the matter.
I cannot belive that they had not pulled this same scam before me and my question slightly long winded sorry about that is the bank is hiding behind banking policy because I sent it over if I had known I was going to be scam it would not of happened but if it had been done via visa card I would get my money back
So the question is has anyone tried and threaten to take a bank to the small claims court and had any sucess as I belive they have alond a fraud activity to occur under their noses without doing anything about. As I have provided with this second attempted with me.:money:

What's confusing?
Happy Bear (HB) gets conned out of money by transferring to con mans bank.
Realises what's happened & talks to His/her Building Society (BS)
BS talks to con mans bank & the bank tells BS or HB that account will be shut down.
Con man contacts HB again with same bank account details, HB wonders why account active when bank told them it would be shut down.
Happy Bear I'd guess that the bank could be doing it's own investigating into fraud & it might take a while, don't know why you were told differently though.0 -
Spanks post seems spot on. I would have thought police and then banking ombudsman would be the way to go. The OP's post is perfectly understandable and follows on in a logical way. To answer the OP's question - the bank can open , suspend and close a bank account more or less at its own disgression but that does not necessarily exclude the possiblity of a mistake happening in this case."if the state cannot find within itself a place for those who peacefully refuse to worship at its temples, then it’s the state that’s become extreme".Revd Dr Giles Fraser on Radio 4 20170

Was it exactly the same account number just with one initial different in the name, or was it a new account number, same surname but different initial?0 -
OP, just because the scammer gave your friend the same account number, it does not necessarily mean that the bank have not closed the account.
It could just mean that the scammer is not bright enough to notice that the account has been closed.
Probably not a good idea to test that theory by sending money though.
