I've amended that paragraph to emphasise GPEOL losses, rather than losses in general. It may also be why there have been so many PSDSUs where GPEOL has been cited - thereby preventing more recent GPEOL losses to rack up in POPLA records?
Cheers. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Musings: this seems too detailed and too well expressed to have been drafted internally. I wonder whether this is a joint venture between some of the PPC heavyweights and this, under the VCS banner, is a tracer to ascertain future strategy?
It may also be why there have been so many PSDSUs where GPEOL has been cited - thereby preventing more recent losses to rack up in POPLA records? My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -

This is the killer statement:-
nevertheless it remains that a charge for damages must be compensatory in nature rather than punitive.
In this case, it is clear that the dominant purpose of the charge is to deter vehicles from staying beyond the 90 minute limit. Accordingly, I am not satisfied that the charge can be commercially justified. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
