I do not mean argue as in a quarrel I meant argue as in citing reasons. To the layman the website suggests you wait and when you ring HMRC they also advise you to ring later, possibly to avoid calculating and issuing unnecessary award notices.
I haven't had dealings with JSA. Never claimed it and never worked there so I don't know the legal aspects.

The onus would not be on DWP to check tax credits entitlement. They are in fact more thorough than HMRC when requesting income details and proof on a claim form. Just as you do not know the legal aspects of JSA you can't expect them to know the legal aspects of WTC.
What if they never returned to work within 4 weeks or at all. The claims could have read simultaneously for months without either side picking it up.
Yes but the claimant would then be guilty of fraud, not necessarily with DWP unless they did not declare the WTC when they moved on to IB JSA, but certainly with HMRC and they would be subject to penalties as well as an overpayment.

I do expect them to check that there isn't working tax credit in payment.
This is something that they did do in the past. JCP previously had a direct line to HMRC and could ask them if WTC was still in payment and if so, if it was the 4 week run on.
Do HMRC check whether JSA is in payment when someone claims WTC?
Maybe in this case JCP did ring HMRC and confirmed entitlement?
Maybe the JCP only check if it was IB JSA?
Maybe you expect too much?
In truth if the claimant was only on JSA for 2 - 3 weeks by the time she had a claim interview and the claim was processed she would have been back to work, signed off and just receive the JSA owed into her bank account.The most potent weapon of the oppressor is the mind of the oppressed.
