    Well, my hearing was delayed but this morning I had an Email containing Minster Baywatch's response to my appeal so things are moving.

    Not sure how long it will be until I hear the outcome of the appeal but I'll post an update when I do.

    Fingers crossed my appeal is successful.

    This sounds like the evidence pack. You now need to go through that with a fine tooth comb and if there are any things you disagree with or that are wrong you need to let POPLA know.

    Having read the thread indicated, I'm really not sure that there is anything I can pick out of the Minster Baywatch response.

    They have said "In response to Ms X's claim that the driver of the vehicle was disabled and a registered blue badge holder, Minster Baywatch assert Ms X has provided no evidence of this. A copy of Ms X's own disabled badge has been provided with this initial appeal however, as Ms X has chosen not to name ther driver of the vehicle, this does not provide any evidence that the driver of the vehicle held a valid disabled badge."

    They have also provided photographic evidence of the dashboard and made a point of marking out the staff permit to park on the windscreen. I was the driver, I work at the hospital but I'm not sure how to respond to this, or even if I need to.

    They have provided no pictures of the inside of the vehicle where my blue badge is clearly visible, laid on the shelf. I just forgot to lift it onto the dashboard. I don't know if this is relevant or worth mentioning either.

    The driver of the vehicle may well not have any Blue Badge; but, they could be carrying a passenger who is a BB holder, and this could of course be the RK - and as such would have rights conferred under the EA 2010.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Have they stated their GPEOL calculation of 'costs/loss? Can we see a link to it please as I haven't seen a MB version and we may be able to tear it apart for you.

    Have they shown a site agreement or contract with the landowner, does it cover the date of this parking event, and does it say whether MB can pursue the charges in the courts if necessary?

    If you received the evidence pack a week ago, you are cutting it fine for getting any further evidence to POPLA. They tend to only send a week or so before appeal is held. So you need to get moving on this!

    The keeper does not have to be disabled, nor indeed the driver. There only has to be one passenger in the car who is disabled with/without a blue badge for EA2010 to apply.

    And the fact that you have a staff permit means there is no loss to the PPC. So this is a punitive charge not a GPEOL.

    No, if it has personal details do not post here. Can you not just take another photo of it and upload with the personal details covered?

    use post-its or similar to cover up personal info, then scan or take a photo and upload that, or link to it using tinypic or photobucket
