It sounds to me like your income support being stopped, is the reason that your HB has been stopped but I have to say, I think you are going to find it a challenge to get it re-instated.

When we consider capital, we look at all assets you have access to and it sounds like this flat is such an asset. Your name being on the deeds is the clincher, not who pays or has paid the mortgage. Under English Law, you have a right to funds from that property and therefore, ordinarily, the asset would be considered as capital.

I think you really need specialist advice from either CAB or a Welfare Rights Unit

Same thing happened with a friend of mine, do she pushed the divorce through, signed the home over to him as part of the divorce settlement, (she hadn't paid in anything) and then HB etc., was fine.
